PROPERTY/PUBLIC:  Exempts certain property belonging to Lafayette and Lafayette
Parish from third party transfer requirements
1	AN ACT
2To amend and reenact R.S. 41:1338(A)(2)(b), relative to the transfer of public property; to
3 provide relative to restrictions on the transfer of public property acquired by the state
4 and political subdivisions; to exempt property of Lafayette or Lafayette Parish from
5 third party transfer requirements; to provide for an effective date; and to provide for
6 related matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 41:1338(A)(2)(b) is hereby amended and reenacted to read as
9follows:
10 ยง1338.  Transfers of property acquired by the state or political subdivision;

14	(2)  The provisions of this Subsection shall not apply to the following:

16	(b)  Property acquired or transferred by the governing authority authorities
17 of the city of Shreveport, or the governing authority of Caddo Parish, the city of
18 Lafayette, or Lafayette Parish.

1 Section 2.  This Act shall become effective upon signature by the governor or, if not
2signed by the governor, upon expiration of the time for bills to become law without signature
3by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
4vetoed by the governor and subsequently approved by the legislature, this Act shall become
5effective on the day following such approval.

Abstract:  Exempts property acquired or transferred by the city of Lafayette or Lafayette
Parish from the requirement, that prior to transferring property to a third party, the
property must first be offered to the person from whom it was originally transferred.
Present law requires that when the state or any political subdivision of the state acquires any
property which it subsequently wishes to transfer to another person, the owner who
transferred it to the state or the political subdivision must first be offered the property at fair
market value.  Present law provides for exemptions to this requirement.
Proposed law retains present law exemptions and further exempts property acquired or
transferred by the governing authorities of the city of Lafayette and Lafayette Parish.
Effective upon signature of governor or lapse of time for gubernatorial action.
