MTR VEHICLE/DRIVER LIC:  Provides relative to the issuance of identification cards
1	AN ACT
2To amend and reenact R.S. 32:412.1(A) and (B), R.S. 40:1321(C)(introductory paragraph)
3 and (2), and (D)(1)(a)(introductory paragraph) and (i) and to enact R.S. 40:1321.1,
4 relative to the duration of special identification cards; to provide that the special
5 identification cards be renewed every six years; to provide for fees; to provide for
6 the distribution of revenue; to create and provide for special funds; and to provide
7 for related matters.
8Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 32:412.1(A) and (B), R.S. 40:1321(C)(introductory paragraph) and
10(2), and R.S. 40:1321(D)(1)(a)(introductory paragraph) and (i) are hereby amended and
11reenacted and R.S. 40:1321.1 is hereby enacted to read as follows:
12 §412.1.  Handling charges
13	A.  Except as provided for in Subsection E of this Section, the office of motor
14 vehicles shall collect, in addition to any fee authorized by law, a handling charge of
15 eight dollars for each of the following transactions:
16	(2)  Identification cards:
17	(a)  New applications.
18	(b)  Renewals.
19	(c)  Duplicates.
20	(3)  Vehicle titling and registration:

1	(a)(1)  New vehicle or out-of-state title.
2	(b)(2)  Transfer of ownership.
3	(c)(3)  Record and cancel mortgage.

5	(e)(5)  Conversion of license plate.
6	(f)(6)  Duplicate title.
7	(g)(7)  Letter of authorization to operate an unregistered vehicle.

26	B.(1)  Except as provided in Subsection E of this Section, the office of motor
27 vehicles shall collect, in addition to any fee authorized by law, a handling charge of
28 twelve dollars for each of the following Class D and E driver's license transactions.:

1	(2)(b)  Renewals.
2	(3)(c)  Duplicates.

4	(2)  Except as provided in Subsection E of this Section, the office of motor
5 vehicles shall collect, in addition to any fee authorized by law, a handling charge of
6 twelve dollars for each of the following identification card transactions:
7	(a)  New applications.
8	(b)  Renewals.
9	(c)  Duplicates.

11 §1321.  Special identification cards; issuance; veteran designation; disabled veteran
12	designation; university logo; "I'm a Cajun" designation; needs
13	accommodation designation; fees; expiration and renewal; exceptions;
14	promulgation of rules; promotion of use; persons less than twenty-one years
15	of age; the Protect and Save our Children Program; Selective Service
16	Registration

18	C. This Subsection and Subsection D of this Section shall establish and be
19 cited as the Protect and Save our Children Program for issuance of special
20 identification cards for persons under the age of sixteen.  The fee for the issuance or
21 renewal of a special identification card for persons under the age of sixteen shall be
22 three dollars for a two-year identification card and five dollars seven dollars and fifty
23 cents for a four-year six-year identification card.  The fee for the issuance or renewal
24 of a special identification card for persons sixteen years of age or older shall be ten
25 fifteen dollars.  However, this fee shall be waived for:

27	(2)  Any child who is in foster care as defined in Article 603 of the Louisiana
28 Children's Code Article 603.

1	D.(1)(a)  Each special identification card issued to a person under the age of
2 sixteen shall expire every two years for the three-dollar identification card and every
3 four six years for the five-dollar seven dollar and fifty cents identification card and
4 may be renewed only by personal appearance.  Each special identification card for
5 a person sixteen years of age or older shall expire every four six years but may be
6 renewed.  The OMV may issue the special identification for a period of less than four
7 six years in circumstances of medical, legal presence, or other special restriction.
8 Where the OMV issues a special identification card to a properly documented alien
9 student or a nonresident alien, the special identification card shall both:
10	(i)  Expire on the date for which the alien's immigration documents expire or
11 four six years after issuance, whichever is sooner.

13 §1321.1 Office of Motor Vehicles Special Identification Card Escrow Fund.
14	A.  There is hereby created, as a special fund in the state treasury, the Office
15 of Motor Vehicles Special Identification Card Escrow Fund.
16	B.(1)  After compliance with the requirements of Article VII, Section 9(B)
17 of the Constitution of Louisiana relative to the Bond Security and Redemption Fund,
18 and after a sufficient amount is allocated from that fund to pay all of the obligations
19 secured by the full faith and credit of the state which become due and payable within
20 any fiscal year, the treasurer shall pay an amount equal to one third of the monies
21 received by the state treasury pursuant to the provisions of R.S. 40:1321 into the
22 Office of Motor Vehicles Special Identification Card Escrow Fund.  The monies in
23 this fund shall be used solely as provided in Paragraph (2) of this Subsection.  All
24 unexpended and unencumbered monies in this fund at the end of the fiscal year shall
25 remain in the fund to cover under collections in any subsequent fiscal year.  The
26 monies in the fund shall be invested by the state treasurer in the same manner as
27 monies in the state general fund and shall be deposited into the state general fund.
28	C.(1)  After compliance with the requirements of Article VII, Section 9(B)

7 unencumbered monies in this fund at the end of the fiscal year shall remain in the
8 fund to cover under collections in any subsequent fiscal year.  The monies in the
9 fund shall be invested by the state treasurer in the same manner as monies in the state
10 general fund and shall be deposited into the state general fund.
11	(2)  Of the monies placed in escrow in the Office of Motor Vehicles Special
12 Identification Card Escrow Fund, one-half shall be appropriated in Fiscal Years
13 2026, 2032, and 2038 and one-half shall be appropriated in Fiscal Years 2027, 2033,
14 and 2039.
15	(2)(a)  Of the monies placed in escrow in the Office of Motor Vehicles
16 Handling Fee Escrow Fund, one-half shall be appropriated in Fiscal Years 2026,
17 2032, and 2038 and one-half shall be appropriated in Fiscal Years  2027, 2033, and
18 2039.
19	(b)  Of the monies appropriated under the provisions of this Subsection,
20 sixty-eight and seventy-five one-hundredths percent of the funds shall be allocated
21 to self-generated revenue and thirty-one and twenty-five one-hundredths percent of
22 the funds shall be allocated to the Office of Motor Vehicles Customer Service and
23 Technology Fund.

Present law requires the office of motor vehicles collect a handling charge of $8.00 for
special identification cards (ID cards), new applications, renewals, and duplicates.  Requires
$2.50 of the fee charged for any handling fee be forwarded to the state treasurer for deposit
into the Office of Motor Vehicles Customer Service and Technology Fund.
Proposed law increases the handling fee for identification cards, renewals, and duplicates
to $12.00. Requires $3.75 on ID card transactions, and $2.50 of the fee charged for all other
handling fees shall be forwarded to the state treasurer for deposit into the Office of Motor
Vehicles Customer Service and Technology Fund.
Present law requires the fee for issuance or renewal of an ID card for persons under the age
of 16 be $3 for a two-year ID card and $5 for a four-year ID card.
Proposed law changes the four-year period to a six-year period and increases the fee of $5
to $7.50.
Present law requires the fee for issuance or renewal of an ID card for persons 16 years or
older be $10.
Proposed law changes the fee from $10 to $15.
Present law authorizes the Office of Motor Vehicles (OMV) to issue an ID card for a period
of less than four years in circumstances of medical, legal presence, or other special
restriction.  Requires the ID card issued to a properly documented alien student or a
nonresident alien expire on the date the alien's immigration documents expire or four years
after issuance, whichever is sooner.
Proposed law changes the four-year period to a six-year period.
Proposed law creates the Office of Motor Vehicles Special Identification Card Escrow Fund,
which are special funds in the state treasury.  Requires that after compliance with the La.
constitution and after a sufficient amount is allocated to pay the obligation secured by the
full faith and credit of the state, the treasure pay an amount equal to 1/3 of the monies
received by the state treasury pursuant to present law (R.S. 40:1321) into the Office of Motor
Vehicles Handling Fee Escrow Fund.  Requires 1/2 of the monies escrowed into the Office
of Motor Vehicles Special Identification Card Escrow Fund be appropriated for Fiscal Years
2026, 2032, and 2038  and 1/2 be appropriated for Fiscal Years  2027, 2033, and 2039.
