HLS 21RS-560 RE-REENGROSSED 2021 Regular Session HOUSE BILL NO. 621 BY REPRESENTATIVE PIERRE MTR VEHICLE/DRIVER LIC: Provides relative to the issuance of identification cards 1 AN ACT 2To amend and reenact R.S. 32:412.1(A) and (B) and 412.3(E) and R.S. 3 40:1321(C)(introductory paragraph) and (2) and (D)(1)(a)(introductory paragraph) 4 and (i) and to enact R.S. 40:1321.1, relative to the duration of special identification 5 cards; to provide that the special identification cards be renewed every six years; to 6 provide for fees; to provide for the distribution of revenue; to create and provide for 7 special funds; and to provide for related matters. 8Be it enacted by the Legislature of Louisiana: 9 Section 1. R.S. 32:412.1(A) and (B) and 412.3(E) are hereby amended and reenacted 10to read as follows: 11 §412.1. Handling charges 12 A. Except as provided for in Subsection E of this Section, the office of motor 13 vehicles shall collect, in addition to any fee authorized by law, a handling charge of 14 eight dollars for each of the following transactions: 15 (2) Identification cards: 16 (a) New applications. 17 (b) Renewals. 18 (c) Duplicates. 19 (3) Vehicle vehicle titling and registration: 20 (a)(1) New vehicle or out-of-state title. Office of Motor Vehicles Driver's License Escrow Fund; Office of Motor 11 Vehicles Handling Fee Escrow Fund 12 * * * 13 E.(1) Of the monies placed in escrow in Monies deposited into the Office of 14 Motor Vehicles Handling Fee Escrow Fund, one-half shall be appropriated available 15 for appropriation in Fiscal Years 2020, 2026, and 2032 and one-half shall be 16 appropriated in Fiscal Years 2021, 2027, and 2033. 2026, 2027, 2032, 2033, 2038, 17 and 2039. 18 (2) Of the monies appropriated under the provisions of this Subsection, 19 sixty-eight and seventy-five one-hundredths percent of the funds shall be allocated 20 to self-generated revenue and thirty-one and twenty-five one-hundredths percent of 21 the funds shall be allocated to the Office of Motor Vehicles Customer Service and 22 Technology Fund. 23 * * * 24 Section 2. Special identification cards; issuance; veteran designation; disabled veteran 2 designation; university logo; "I'm a Cajun" designation; needs 3 accommodation designation; fees; expiration and renewal; exceptions; 4 promulgation of rules; promotion of use; persons less than twenty-one years 5 of age; the Protect and Save our Children Program; Selective Service 6 Registration 7 * * * 8 C. This Subsection and Subsection D of this Section shall establish and be 9 cited as the Protect and Save our Children Program for issuance of special 10 identification cards for persons under the age of sixteen. The fee for the issuance or 11 renewal of a special identification card for persons under the age of sixteen shall be 12 three dollars for a two-year identification card and five dollars seven dollars and fifty 13 cents for a four-year six-year identification card. The fee for the issuance or renewal 14 of a special identification card for persons sixteen years of age or older shall be ten 15 fifteen dollars. However, this fee shall be waived for: 16 * * * 17 (2) Any child who is in foster care as defined in Article 603 of the Louisiana 18 Children's Code Article 603. 19 D.(1)(a) Each special identification card issued to a person under the age of 20 sixteen shall expire every two years for the three-dollar identification card and every 21 four six years for the five-dollar seven dollar and fifty cents identification card and 22 may be renewed only by personal appearance. Each special identification card for 23 a person sixteen years of age or older shall expire every four six years but may be 24 renewed. The OMV may issue the special identification for a period of less than four 25 six years in circumstances of medical, legal presence, or other special restriction. 26 Where the OMV issues a special identification card to a properly documented alien 27 student or a nonresident alien, the special identification card shall both: Page 4 of 7 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HLS 21RS-560 RE-REENGROSSED HB NO. 621 1 (i) Expire on the date for which the alien's immigration documents expire or 2 four six years after issuance, whichever is sooner. 3 * * * 4 §1321.1. Office of Motor Vehicles Special Identification Card Dedicated Fund 5 Account 6 A. There is hereby created, as a special statutorily dedicated fund account 7 in the state treasury, the Office of Motor Vehicles Special Identification Card 8 Dedicated Fund Account, hereafter referred to as the "Identification Card Account". 9 B. After compliance with the requirements of Article VII, Section 9(B) of 10 the Constitution of Louisiana relative to the Bond Security and Redemption Fund, 11 the treasurer shall pay an amount equal to one-third of the monies received by the 12 state treasury pursuant to the provisions of R.S. 40:1321(C) into the Identification 13 Card Account. Monies in the account shall be used for operational expenses of the 14 Department of Public Safety and Corrections, public safety services. All 15 unexpended and unencumbered monies in the account at the end of the fiscal year 16 shall remain in the account. Monies in the account shall be invested by the state 17 treasurer in the same manner as monies in the state general fund and shall be 18 deposited into the state general fund. 19 C. Monies deposited into the Identification Card Account shall be available 20 for appropriation in Fiscal Years 2026, 2027, 2032, 2033, 2038, and 2039. 21 D. Monies deposited into the Identification Card Account shall be 22 categorized as fees and self-generated revenue for the sole purpose of reporting 23 related to the executive budget, supporting documents, and general appropriations 24 bill and shall be available for annual appropriation by the legislature. 25 E. The provisions of this Section shall be null, void, and of no effect 26 beginning on July 1, 2039. Present law requires the office of motor vehicles collect a handling charge of $8.00 for special identification cards (ID cards), new applications, renewals, and duplicates. Requires $2.50 of the fee charged for any handling fee be forwarded to the state treasurer for deposit into the Office of Motor Vehicles Customer Service and Technology Fund. Proposed law increases the handling fee for identification cards, renewals, and duplicates to $12.00. Proposed law retains present law and requires monies deposited into the Office of Motor Vehicles Handling Fee Escrow Fund be available for appropriation in various Fiscal Years. Present law requires the fee for issuance or renewal of an ID card for persons under the age of 16 be $3 for a two-year ID card and $5 for a four-year ID card. Proposed law changes the four-year period to a six-year period and increases the fee of $5 to $7.50. Present law requires the fee for issuance or renewal of an ID card for persons 16 years or older be $10. Proposed law changes the fee from $10 to $15. Present law authorizes the Office of Motor Vehicles (OMV) to issue an ID card for a period of less than four years in circumstances of medical, legal presence, or other special restriction. Requires the ID card issued to a properly documented alien student or a nonresident alien expire on the date the alien's immigration documents expire or four years after issuance, whichever is sooner. Proposed law changes the four-year period to a six-year period. Proposed law creates the Office of Motor Vehicles Special Identification Card Escrow Fund, which is a special statutorily dedicated fund account in the state treasury. Requires that after compliance with the La. constitution the treasurer pay an amount equal to 1/3 of the monies received by the state treasury pursuant to present law (R.S. 40:1321(C)) into the Identification Card Account.
