ENROLLED ACT No. 348 2021 Regular Session HOUSE BILL NO. 621 BY REPRESENTATIVE PIERRE 1 AN ACT 2 To amend and reenact R.S. 32:412.1(A) and (B) and 412.3(E) and R.S. 3 40:1321(C)(introductory paragraph) and (2) and (D)(1)(a)(introductory paragraph) 4 and (i) and to enact R.S. 40:1321.1, relative to the duration of special identification 5 cards; to provide that the special identification cards be renewed every six years; to 6 provide for fees; to provide for the distribution of revenue; to create and provide for 7 special funds; and to provide for related matters. 8 Be it enacted by the Legislature of Louisiana: 9 Section 1. R.S. 32:412.1(A) and (B) and 412.3(E) are hereby amended and reenacted 10 to read as follows: 11 §412.1. Handling charges 12 A. Except as provided for in Subsection E of this Section, the office of motor 13 vehicles shall collect, in addition to any fee authorized by law, a handling charge of 14 eight dollars for each of the following transactions: 15 (2) Identification cards: 16 (a) New applications. 17 (b) Renewals. 18 (c) Duplicates. 19 (3) Vehicle vehicle titling and registration: 20 (a)(1) New vehicle or out-of-state title. 21 (b)(2) Transfer of ownership. HB NO. 621 ENROLLED 1 (c)(3) Record and cancel mortgage. 2 (d)(4) Lost plate and sticker. 3 (e)(5) Conversion of license plate. 4 (f)(6) Duplicate title. 5 (g)(7) Letter of authorization to operate an unregistered vehicle. 6 (h)(8) Motor vehicle inspection sticker and rejection stickers. 7 (i)(9) Motor vehicle inspection station permits. 8 (j)(10) Duplicate motor vehicle inspection station permits. 9 (k)(11) Motor vehicle inspection station signs. 10 (l)(12) Motor vehicle inspection mechanic inspection license. 11 (m)(13) Duplicate motor vehicle inspection mechanic inspection license. 12 (n)(14) Sheriff's certificate of chattel mortgages. 13 (o)(15) Recordation of floor plans. 14 (p)(16) Dealer temporary marker. 15 (q)(17) Agriculture permits. 16 (r)(18) Refunds - driver's license and vehicle registration. 17 (s)(19) Certified copies. 18 (t)(20) Claims against dealer bonds. 19 (u)(21) Titles, certificates, or similar documents for salvaged vehicles. 20 (v)(22) Department of Transportation and Development ticket assessments. 21 (w)(23) Nonresident cab cards. 22 (x)(24) Reciprocity cab cards. 23 (y)(25) Records created by R.S. 9:1149.4(D). 24 B.(1) Except as provided in Subsection E of this Section, the office of motor 25 vehicles shall collect, in addition to any fee authorized by law, a handling charge of 26 twelve dollars for each of the following Class D and E driver's license transactions.: 27 (1)(a) New applications. 28 (2)(b) Renewals. 29 (3)(c) Duplicates. 30 (4)(d) Valid without photo. HB NO. 621 ENROLLED 1 (2) Except as provided in Subsection E of this Section, the Office of Motor 2 Vehicles shall collect, in addition to any fee authorized by law, a handling charge of 3 twelve dollars for each of the following identification card transactions: 4 (a) New applications. 5 (b) Renewals. 6 (c) Duplicates. 7 * * * 8 §412.3. Office of Motor Vehicles Driver's License Escrow Fund; Office of Motor 9 Vehicles Handling Fee Escrow Fund 10 * * * 11 E.(1) Of the monies placed in escrow in Monies deposited into the Office of 12 Motor Vehicles Handling Fee Escrow Fund, one-half shall be appropriated available 13 for appropriation in Fiscal Years 2020, 2026, and 2032 and one-half shall be 14 appropriated in Fiscal Years 2021, 2027, and 2033. 2026, 2027, 2032, 2033, 2038, 15 and 2039. 16 (2) Of the monies appropriated under the provisions of this Subsection, 17 sixty-eight and seventy-five one-hundredths percent of the funds shall be allocated 18 to self-generated revenue and thirty-one and twenty-five one-hundredths percent of 19 the funds shall be allocated to the Office of Motor Vehicles Customer Service and 20 Technology Fund. 21 * * * 22 Section 2. R.S. 40:1321(C)(introductory paragraph) and (2) and 23 (D)(1)(a)(introductory paragraph) and (i) are hereby amended and reenacted and R.S. 24 40:1321.1 is hereby enacted to read as follows: 25 §1321. Special identification cards; issuance; veteran designation; disabled veteran 26 designation; university logo; "I'm a Cajun" designation; needs 27 accommodation designation; fees; expiration and renewal; exceptions; 28 promulgation of rules; promotion of use; persons less than twenty-one years 29 of age; the Protect and Save our Children Program; Selective Service 30 Registration 31 * * * Page 3 of 5 CODING: Words in struck through type are deletions from existing law; words underscored are additions. This Subsection and Subsection D of this Section shall establish and be 2 cited as the Protect and Save our Children Program for issuance of special 3 identification cards for persons under the age of sixteen. The fee for the issuance or 4 renewal of a special identification card for persons under the age of sixteen shall be 5 three dollars for a two-year identification card and five dollars seven dollars and fifty 6 cents for a four-year six-year identification card. The fee for the issuance or renewal 7 of a special identification card for persons sixteen years of age or older shall be ten 8 fifteen dollars. However, this fee shall be waived for: 9 * * * 10 (2) Any child who is in foster care as defined in Article 603 of the Louisiana 11 Children's Code Article 603. 12 D.(1)(a) Each special identification card issued to a person under the age of 13 sixteen shall expire every two years for the three-dollar identification card and every 14 four six years for the five-dollar seven dollar and fifty cents identification card and 15 may be renewed only by personal appearance. Each special identification card for 16 a person sixteen years of age or older shall expire every four six years but may be 17 renewed. The OMV may issue the special identification for a period of less than four 18 six years in circumstances of medical, legal presence, or other special restriction. 19 Where the OMV issues a special identification card to a properly documented alien 20 student or a nonresident alien, the special identification card shall both: 21 (i) Expire on the date for which the alien's immigration documents expire or 22 four six years after issuance, whichever is sooner. 23 * * * 24 §1321.1. Office of Motor Vehicles Special Identification Card Dedicated Fund 25 Account 26 A. There is hereby created, as a special statutorily dedicated fund account 27 in the state treasury, the Office of Motor Vehicles Special Identification Card 28 Dedicated Fund Account, hereafter referred to as the "Identification Card Account". 29 B. After compliance with the requirements of Article VII, Section 9(B) of 30 the Constitution of Louisiana relative to the Bond Security and Redemption Fund, 31 the treasurer shall pay an amount equal to one-third of the monies received by the Page 4 of 5 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HB NO. 621 ENROLLED 1 state treasury pursuant to the provisions of R.S. 40:1321(C) into the Identification 2 Card Account. Monies in the account shall be used for operational expenses of the 3 Department of Public Safety and Corrections, public safety services. All 4 unexpended and unencumbered monies in the account at the end of the fiscal year 5 shall remain in the account. Monies in the account shall be invested by the state 6 treasurer in the same manner as monies in the state general fund and shall be 7 deposited into the state general fund. 8 C. Monies deposited into the Identification Card Account shall be available 9 for appropriation in Fiscal Years 2026, 2027, 2032, 2033, 2038, and 2039. 10 D. Monies deposited into the Identification Card Account shall be 11 categorized as fees and self-generated revenue for the sole purpose of reporting 12 related to the executive budget, supporting documents, and general appropriations 13 bill and shall be available for annual appropriation by the legislature. 14 E. The provisions of this Section shall be null, void, and of no effect 15 beginning on July 1, 2039.
