MTR VEHICLE/DRIVER LIC: Provides relative to driver's license transactions 1 AN ACT 2To amend and reenact R.S. 32:406 and 412.1(B), relative to driver's license transactions; 3 to provide relative to the issuance of Class D and E driver's license transactions for 4 a change of address; to authorize a licensee to update their permanent address in 5 person, by mail, or online; to exempt certain driver's license handling fees; and to 6 provide for related matters. 7Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 32:406 and 412.1(B) are hereby amended and reenacted to read as 9follows: 10 §406. Licensee must give notice of change of address 11 A. Whenever any person after applying for or receiving a license shall move 12 permanently from the address or place of residence named in the application he shall, 13 within ten days thereafter, notify the driver's license division, in writing or 14 electronically of such change and of his new address. 15 B.(1) A licensee may update their permanent address in person, by mail, or 16 online to correct their address for the issuance of a Class "D" or "E" license. The 17 reconstructed driver's license shall be mailed to the licensee's updated permanent 18 address. The provisions of this Act shall not apply to the REAL ID. 5 * * * 6 §412.1. Handling charges 7 * * * 8 B.(1) Except as provided in Subsection E of this Section, the office of motor 9 vehicles shall collect, in addition to any fee authorized by law, a handling charge of 10 twelve dollars for each of the following Class D and E driver's license transactions. 11 (1)(a) New applications. 12 (2)(b) Renewals. 13 (3)(c) Duplicates. 14 (4)(d) Valid without photo. 15 (2) The provisions of this Subsection shall not apply to Class D and E 16 driver's licenses for a duplicate transaction pursuant to R.S. 32:406 when the change 17 of address was caused by the renaming of a street or highway in accordance with a 18 parish or municipal ordinance. 19 * * * 20 Section 2. The Department of Public Safety and Corrections, office of motor 21vehicles, shall promulgate rules and regulations in accordance with the Administrative 22Procedure Act to implement the provisions of this Act. Present law requires a person to notify the driver's license division in writing within 10 days of a change of address after applying for a driver's license. Proposed law authorizes a licensee to update their permanent address in person, by mail, or online to have their license issued with the correct address for Class "D" and "E" licenses. Proposed law requires the reconstructed license be mailed to the licensee's updated permanent address. Proposed law prohibits the application of proposed law to the REAL ID. Present law requires that the Dept. of Public Safety and Corrections, office of motor vehicles (OMV), collect a handling charge of $12 for new applications, renewals, duplicates, and valid without photo for Class D and Class E driver's license transactions in addition to any fee authorized by present law. Present law requires any person who, after applying for or receiving a license, moves from the address, place, or residence listed in the application to notify the driver's license division within 10 days, in writing, of the new address, but otherwise maintains present law. Proposed law waives the handling charge of $12 for duplicate transactions pursuant to present law when the change of address was caused by the renaming of a street or highway due to a municipal or parish ordinance. Proposed law requires the OMV to promulgate rules and regulations adjusting the La. Administrative Code to appropriately conform with the provisions of this Act.
