ENROLLED 2021 Regular Session HOUSE BILL NO. 638 BY REPRESENTATIVES HILFERTY AND DUPLESSIS 1 AN ACT 2 To amend and reenact R.S. 32:406 and 412.1(B) and to enact R.S. 40:1321(S) and R.S. 3 47:472(C), relative to driver's license transactions; to provide relative to the issuance 4 of Class "D" and "E" driver's license transactions for a change of address; to 5 authorize a licensee to update their permanent address in person, by mail, or online; 6 to exempt certain driver's license handling fees; to provide relative to the issuance 7 of a Real ID compliant license; to exempt certain duplicate certificate of registration 8 fees; and to provide for related matters. 9 Be it enacted by the Legislature of Louisiana: 10 Section 1. R.S. 32:406 and 412.1(B) are hereby amended and reenacted to read as 11 follows: 12 §406. Licensee must give notice of change of address 13 A. Whenever any person after applying for or receiving a license shall move 14 permanently from the address or place of residence named in the application he shall, 15 within ten days thereafter, notify the driver's license division, in writing or 16 electronically of such change and of his new address. 17 B.(1) A licensee may update their permanent address in person, by mail, or 18 online to correct their address for the issuance of a Class "D" or "E" license. The 19 reconstructed driver's license shall be mailed to the licensee's updated permanent 20 address. 21 (2) No cost shall apply pursuant to R.S. 32:412.1 and R.S. 32:413 for 22 transactions to correct an address due to the renaming of a street or highway in 23 accordance with a parish or municipal ordinance. The provisions contained in Subsection B of this Section shall not apply 2 to a license which is Real ID compliant. The address of a Real ID compliant license 3 shall be changed at a motor vehicle field office or the office of a public license tag 4 agent authorized to issue Real ID compliant licenses. 5 * * * 6 §412.1. Handling charges 7 * * * 8 B.(1) Except as provided in Subsection E of this Section, the office of motor 9 vehicles shall collect, in addition to any fee authorized by law, a handling charge of 10 twelve dollars for each of the following Class "D" and "E" driver's license 11 transactions. 12 (1)(a) New applications. 13 (2)(b) Renewals. 14 (3)(c) Duplicates. 15 (4)(d) Valid without photo. 16 (2) The provisions of this Subsection shall not apply to Class "D" and "E" 17 driver's licenses for a duplicate transaction pursuant to R.S. 32:406 when the change 18 of address was caused by the renaming of a street or highway in accordance with a 19 parish or municipal ordinance. 20 * * * 21 Section 2. R.S. 40:1321(S) is hereby enacted to read as follows: 22 §1321. Special identification cards; issuance; veteran designation; disabled veteran 23 designation; university logo; "I'm a Cajun" designation; needs 24 accommodation designation; fees; expiration and renewal; exceptions; 25 promulgation of rules; promotion of use; persons less than twenty-one years 26 of age; the Protect and Save our Children Program; Selective Service 27 Registration 28 * * * Page 2 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. No fee shall be charged for transactions to issue a duplicate special 2 identification card to correct an address due to the renaming of a street or highway 3 in accordance with a parish or municipal ordinance. 4 * * * 5 Section 3. R.S. 47:472(C) is hereby enacted to read as follows: 6 §472. Lost certificate or number plate 7 * * * 8 C. No fee shall be charged for transactions to issue a duplicate certificate of 9 registration to correct an address due to the renaming of a street or highway in 10 accordance with a parish or municipal ordinance. 11 Section 4. The Department of Public Safety and Corrections, office of motor 12 vehicles, shall promulgate rules and regulations as are necessary in accordance with the 13 Administrative Procedure Act to implement the provisions of this Act.
