HOUSE BILL NO. 679
BY REPRESENTATIVE HILFERTY
SEWERAGE/N O WATER BD:  Provides relative to the Sewerage and Water Board of
New Orleans
1	AN ACT
2To amend and reenact R.S. 33:4091(C)(1)(c) and to enact R.S. 33:4091(G), relative to the
3 city of New Orleans; to provide relative to the Sewerage and Water Board of New
4 Orleans; to provide relative to services provided by the board; to provide relative to
5 the collection of payments owed for such services; to provide relative to the powers
6 and duties of the city's governing authority with respect to the collection of such
7 payments; to provide relative to reports issued by the board; to provide relative to the
8 requirements of such reports; and to provide for related matters.
9	Notice of intention to introduce this Act has been published
10	as provided by Article III, Section 13 of the Constitution of
11	Louisiana.
12Be it enacted by the Legislature of Louisiana:
13 Section 1.  R.S. 33:4091(C)(1)(c) is hereby amended and reenacted and R.S.
1433:4091(G) is hereby enacted to read as follows:
15 ยง4091.  Reports of board

17	C.  In addition to the requirements of Subsections A and B of this Section,
18 the board shall report quarterly no later than the first day of the second month
19 following the close of each calendar quarter to the city council relative to its

1 operations.  The report shall include the following in a manner as prescribed by the
2 city council:
3	(1)  Standard industry metrics for best practice, including but not limited to:

5	(c)  Percentage and total value of receivables outstanding, including a
6 delinquency schedule and a copy of the board's policies and procedures for bill
7 collection.

9	G.  Notwithstanding any other provision of law to the contrary, if reports
10 submitted by the board pursuant to this Section provide that the aggregate total value
11 of unpaid bills for services provided by the board has increased for two consecutive
12 quarters, then the city council may adopt and implement such rules and regulations
13 as it deems necessary to enforce the collection of such unpaid bills.

Abstract:  Requires that additional content be included in reports submitted to the New
Orleans city council by the New Orleans Sewerage and Water Board, and grants the
city council certain powers with respect to the collection of unpaid bills.
Present law requires the New Orleans Sewerage and Water Bd. (board) to report quarterly
to the city council relative to its operations.  Provides relative to the content requirements
of the report including the percentage of receivables outstanding, including a delinquency
schedule.
Proposed law retains present law and additionally requires that the report contain the total
value of receivables outstanding and a copy of the board's policies and procedures for bill
collection.
Proposed law authorizes the city council to adopt and implement rules and regulations to
enforce bill collection if reports submitted by the board provide that the aggregate total value
of unpaid bills for services has increased for two consecutive quarters.
