STUDENTS:  Provides relative to the sharing of certain student data
1	AN ACT
2To amend and reenact R.S. 17:3914(K)(2) and (3)(c)(i) and  to enact R.S. 17:3914(K)(1)(e),
3 relative to the collection and sharing of student data and information; to provide for
4 the use of such information for specified purposes; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 17:3914(K)(2) and (3)(c)(i) are hereby amended and reenacted and
7R.S. 17:3914(K)(1)(e) is hereby enacted to read as follows:
8 ยง3914.  Student information; privacy; legislative intent; definitions; prohibitions;
9	parental access; penalties

11	K.(1)  Notwithstanding any provision of this Part to the contrary, the
12 governing authority of each public school, with the permission of a student's parent
13 or legal guardian, shall collect the following personally identifiable information for
14 each student enrolled in grades eight through twelve:

16	(e)  Race and ethnicity data.
17	(2)  The governing authority of a public school and the company that the state
18 has contracted with to develop the unique student identifier shall disclose the
19 information collected pursuant to Paragraph (1) of this Subsection, upon request,
20 only to:

1	(a)  A Louisiana postsecondary education institution, to be used solely for the
2 purpose of processing applications for admission and for compliance with state and
3 federal reporting requirements.
4	(b)  The Board of Regents and the Office of Student Financial Assistance, as
5 a program under its jurisdiction, to be used solely for the purpose of processing
6 applications made to the office for state and federal grants and for required grant
7 program reporting, for the purposes of providing reports to each public school
8 governing authority on the postsecondary education remediation needs, retention
9 rates, and graduation rates for each high school under its jurisdiction, and for the
10 purpose of evaluating comparative postsecondary education performance outcomes
11 based on student transcript data in order to develop policies designed to improve
12 student academic achievement.
13	(c)  The Board of Regents, to be used only by board staff for the purposes of
14 providing reports to each public school governing authority on the postsecondary
15 remediation needs, retention rates, and graduation rates for each high school under
16 its jurisdiction and to evaluate comparative postsecondary performance outcomes
17 based upon student transcript data in order to develop policies designed to improve
18 student academic achievement.

21	(c)  The form shall contain the following:
22	(i)  A statement notifying the student's parent or legal guardian exactly what
23 items of student information will be collected and that disclosure of the student
24 information collected will be restricted to Louisiana postsecondary education
25 institutions to be used for the purposes of processing applications for admission and
26 for compliance with state and federal reporting requirements to the Board of Regents
27 and to the Office of Student Financial Assistance, as a program under such board's
28 jurisdiction, to be used solely for the purpose purposes of processing applications for
29 admission and for state and federal financial aid and to the Board of Regents to be

1 used solely for the purposes of for required grant program reporting, for providing
2 reports to the school governing authority on the postsecondary education remediation

4 jurisdiction, and for evaluating comparative postsecondary education performance
5 outcomes based on student transcript data in order to develop and developing
6 policies designed to improve student academic achievement.

Abstract:  Provides relative to the sharing of students' personally identifiable information
by public school governing authorities.
Present law prohibits an official or employee of a local public school system from requiring
the collection of certain student information unless voluntarily disclosed by the parent or
legal guardian.  Further prohibits any employee of a public school system from providing
a student's personally identifiable information to any person or public or private entity.
Present law defines personally identifiable information as information about an individual
that can be used, on its own or with other information, to identify, contact, or locate a single
individual.
Present law includes exceptions to the prohibitions.  One exception is present law authorizes
public school governing authorities, with parental permission, to collect certain personally
identifiable information for students in grades eight through 12.  Authorizes the sharing of
such information with La. postsecondary education institutions, the La. Office of Student
Financial Assistance, and the Bd. of Regents for specific purposes.  The following personally
identifiable information may be collected and shared in accordance with present law:
(1)Full name.
(2)Date of birth.
(3)Social security number.
(4)Student transcript data.
Proposed law adds race and ethnicity to the information that may be collected and shared. 
Revises purposes for which information may be shared and revises information required to
be on parental notification forms.
Present law authorizes disclosing student information with the Office of Student Financial
Assistance for purposes related to administering state and federal grants.
