HOUSE BILL NO. 711    (Substitute for House Bill No. 563 by Representative Garofalo)
BY REPRESENTATIVES GAROFALO AND JEFFERSON
1	AN ACT
2 To amend and reenact R.S. 17:3914(K)(2) and (3)(c)(i) and  to enact R.S. 17:3914(K)(1)(e),
3 relative to the collection and sharing of student data and information; to provide for
4 the use of such information for specified purposes; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 17:3914(K)(2) and (3)(c)(i) are hereby amended and reenacted and
7 R.S. 17:3914(K)(1)(e) is hereby enacted to read as follows:
8 ยง3914.  Student information; privacy; legislative intent; definitions; prohibitions;
9	parental access; penalties

11	K.(1)  Notwithstanding any provision of this Part to the contrary, the
12 governing authority of each public school, with the permission of a student's parent
13 or legal guardian, shall collect the following personally identifiable information for
14 each student enrolled in grades eight through twelve:

16	(e)  Race and ethnicity data.
17	(2)  The governing authority of a public school and the company that the state
18 has contracted with to develop the unique student identifier shall disclose the
19 information collected pursuant to Paragraph (1) of this Subsection, upon request,
20 only to:

1	(a)  A Louisiana postsecondary education institution, to be used solely for the
2 purpose of processing applications for admission and for compliance with state and
3 federal reporting requirements.
4	(b)  The Office of Student Financial Assistance, Board of Regents and the
5 office of student financial assistance, as a program under its jurisdiction, to be used
6 solely for the purpose of processing applications made to the office for state and
7 federal grants and for required grant program reporting, for the purposes of providing
8 reports to each public school governing authority on the postsecondary education
9 remediation needs, retention rates, and graduation rates for each high school under
10 its jurisdiction, and for the purpose of evaluating comparative postsecondary
11 education performance outcomes based on student transcript data in order to develop
12 policies designed to improve student academic achievement.
13	(c)  The Board of Regents, to be used only by board staff for the purposes of
14 providing reports to each public school governing authority on the postsecondary
15 remediation needs, retention rates, and graduation rates for each high school under
16 its jurisdiction and to evaluate comparative postsecondary performance outcomes
17 based upon student transcript data in order to develop policies designed to improve
18 student academic achievement.

21	(c)  The form shall contain the following:
22	(i)  A statement notifying the student's parent or legal guardian exactly what
23 items of student information will be collected and that disclosure of the student
24 information collected will be restricted to Louisiana postsecondary education
25 institutions to be used for the purposes of processing applications for admission and
26 for compliance with state and federal reporting requirements to the Board of Regents
27 and to the Office of Student Financial Assistance office of student financial
28 assistance, as a program under the board's jurisdiction, to be used solely for the
29 purpose purposes of processing applications for admission and for state and federal
30 financial aid and to the Board of Regents to be used solely for the purposes of for

1 required grant program reporting, for providing reports to the school governing
2 authority on the postsecondary education remediation needs, retention rates, and
3 graduation rates for each high school under its jurisdiction, and for evaluating
4 comparative postsecondary education performance outcomes based on student
5 transcript data in order to develop and developing policies designed to improve
6 student academic achievement.
