RÉSUMÉ DIGEST ACT 255 (HB 74) 2021 Regular Session Frieman Prior law required foreign and alien insurers issuing workers' compensation policies in La. to either maintain a claims office in La. for processing such claims or retain the services of an independent La. domiciled claims adjuster. New law changes prior law by repealing the requirement that the retained claims adjuster be domiciled independently. Prior law provided that all insurers who issued workers' compensation policies in La. would either establish and maintain a claims office within La. or retain a licensed claims adjuster. New law changes prior law by specifying that the retained claims adjuster shall have a La. claims adjuster license. New law provides that any insurer issuing workers' compensation policies in La. shall make any relevant claims adjuster available for deposition via telephone or video conferencing if a disputed claim for compensation is filed in which liability for statutory penalties and attorneys fees is at issue. New law further provides that insurers shall make relevant adjusters available for in person testimony at the insurer's expense if a trial becomes necessary to adjudicate the disputed claim for compensation.
