PUBLIC CONTRACT/BIDS: Exempts the Iberia Parish Airport Authority from the public
lease law applicable to certain properties
1 AN ACT
2To enact R.S. 2:135.1(A)(6), relative to the lease of certain airport facilities governed by the
3 Iberia Parish Airport Authority; to exempt leases governed by the Iberia Parish
4 Airport Authority from the provisions of public lease laws; to require the Iberia
5 Parish Airport Authority to meet certain requirements relative to price and
6 appraisals; and to provide for related matters.
7 Notice of intention to introduce this Act has been published
8 as provided by Article III, Section 13 of the Constitution of
9 Louisiana.
10Be it enacted by the Legislature of Louisiana:
11 Section 1. R.S. 2:135.1(A)(6) is hereby enacted to read as follows:
12 ยง135.1. Authority to equip, improve, establish fees and charges, and lease airport
13 facilities
14 A. Airport districts, airport authorities, and other political subdivisions,
15 including the New Orleans Aviation Board, which establish or operate airports or
16 landing fields or which acquire or set apart immovable property for such purpose
17 may:

19 (6) Notwithstanding any provision of law to the contrary, including in
20 Paragraph (3) of this Subsection, the Iberia Parish Airport Authority, which operates

1 LeMaire Airport in Jeanerette, Louisiana, is authorized to lease to any person, as
2 defined in this Title, land, areas for operations space and improvements, including
3 industrial development, and equipment on such airport or landing field. However,
4 the Iberia Parish Airport Authority, except as provided in this Paragraph, shall charge
5 a fair and reasonable price for airport properties as determined by appraisals and fair
6 market value comparisons in accordance with Federal Aviation Administration
7 guidelines. The appraisals and fair market value comparisons required by this
8 Paragraph shall be conducted and paid for by the Iberia Parish Airport Authority.

Abstract: Authorizes the Iberia Parish Airport Authority to lease certain airport property
without advertising or competitive bidding.
Present law allows any airport district, airport authority, and other political subdivisions,
including the New Orleans Aviation Board, to lease to any person, areas for operations
space, improvements, and equipment on such airport or landing field in accordance with
public bid law and present law provisions relative to the lease of public lands.
Proposed law allows the Iberia Parish Airport Authority, which operates LeMaire Airport
in Jeanerette, Louisiana, to lease land, operations space, improvements, and equipment on
such airport or landing field without advertising or competitive bidding, provided the Iberia
Parish Airport Authority charges fair and reasonable prices for the property, which is
determined by appraisals and fair market value comparisons in accordance with Federal
Aviation Administration guidelines.
Proposed law provides that the appraisals and fair market value comparisons required by
proposed law be conducted and paid for by the Iberia Parish Airport Authority.
