HOUSE CONCURRENT RESOL UTION NO. 106
BY REPRESENTATIVE ORGERON
ALCOHOLIC BEVERAGES:  Creates a task force to study issues associated with the
direct-to-consumer shipment of wine in Louisiana
1	A CONCURRENT RESOL UTION
2To create the Louisiana Direct-to-Consumer Wine Task Force to study the potential issues
3 that may arise by allowing wineries to ship directly to consumers in Louisiana and
4 to recommend any regulations or legislation that the task force deems necessary or
5 appropriate.
6 WHEREAS, several legislative instruments have been introduced to authorize the
7direct shipping of wine to consumers; and
8 WHEREAS, the direct shipping of wine to consumers may have an impact on the
9revenue of the state and on the wholesale and retail markets; and
10 WHEREAS, the sale of alcoholic beverages is regulated by the office of alcohol and
11tobacco control, and the permitting of industry members by the office of alcohol and tobacco
12control is designed to provide regulators the platform to enforce the applicable rules and
13laws in order to provide for a safe marketplace; and
14 WHEREAS, it is urgent that the state consider the benefits other states are
15experiencing with the increased revenue provided by direct wine shipping prior to expanding
16direct to consumer shipping.
17 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby
18create the Louisiana Direct-to-Consumer Wine Task Force to study the issues that may arise
19if regulations and laws expand direct-to-consumer wine deliveries and to recommend any
20action or legislation that the task force deems necessary and appropriate.

1 BE IT FURTHER RESOLVED that the task force shall consist of the following nine
2members:
3 (1)  The commissioner of the office of alcohol and tobacco control, or his designee,
4who shall serve as the chairperson of the task force.
5 (2)  The speaker of the House of Representatives, or his designee.
6 (3)  The president of the Senate, or his designee.
7 (4)  The chair of the Senate Committee on Judiciary B or another member of the
8committee designated by the chair.
9 (5)  The chair of the House Judiciary Committee or another member of the committee
10designated by the chair.
11 (6)  The secretary of the Department of Revenue, or his designee.
12 (7)  The chair of the House Ways and Means Committee or another member of the
13committee designated by the chair.
14 (8)  The chair of the Senate Committee on Revenue and Fiscal Affairs or another
15member of the committee designated by the chair.
16 (9)  The president of the Louisiana Association of Tax Administrators, or his
17designee who is a member of the association.
18 BE IT FURTHER RESOLVED that the task force shall meet as necessary and shall
19report its findings and recommendations to the legislature not later than January 1, 2022, and
20shall terminate upon the date of such report or January 1, 2022, whichever occurs first.
21 BE IT FURTHER RESOLVED that the office of alcohol and tobacco control shall
22be responsible for designating staff of the office of alcohol and tobacco control to assist the
23task force in performing its duties.
24 BE IT FURTHER RESOLVED that the Louisiana Direct-to-Consumer Wine Task
25Force shall submit one print copy and one electronic copy of any report produced pursuant
26to this Resolution to the David R. Poynter Legislative Research Library as required by R.S.
2724:772.
28 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the
29commissioner of alcohol and tobacco control and the secretary of the Louisiana Department
30of Revenue.

report its findings and recommendations no later than Jan. 1, 2022.
Summary of Amendments Adopted by House
The Committee Amendments Proposed by House Committee on Judiciary to the original
bill:
1. Add the president of the La. Association of Tax Administrators, or his designee
as a member of the task force.
The House Floor Amendments to the engrossed bill:
1. Provide that the office of alcohol and tobacco control shall be responsible for
designating staff of the office of alcohol and tobacco control to assist the task
force in performing its duties.
