HOUSE CONCURRENT RESOL UTION NO. 106

A CONCURRENT RESOL UTION
To create the Louisiana Direct-to-Consumer Wine Task Force to study the potential issues
that may arise by allowing wineries to ship directly to consumers in Louisiana and
to recommend any regulations or legislation that the task force deems necessary or
appropriate.
WHEREAS, several legislative instruments have been introduced to authorize the
direct shipping of wine to consumers; and
WHEREAS, the direct shipping of wine to consumers may have an impact on the
revenue of the state and on the wholesale and retail markets; and
WHEREAS, the sale of alcoholic beverages is regulated by the office of alcohol and
tobacco control, and the permitting of industry members by the office of alcohol and tobacco
control is designed to provide regulators the platform to enforce the applicable rules and
laws in order to provide for a safe marketplace; and
WHEREAS, it is urgent that the state consider the benefits other states are
experiencing with the increased revenue provided by direct wine shipping prior to expanding
direct to consumer shipping.
THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby
create the Louisiana Direct-to-Consumer Wine Task Force to study the issues that may arise
if regulations and laws expand direct-to-consumer wine deliveries and to recommend any
action or legislation that the task force deems necessary and appropriate.
BE IT FURTHER RESOLVED that the task force shall consist of the following nine
members:
(1)  The commissioner of the office of alcohol and tobacco control, or his designee,
who shall serve as the chairperson of the task force.

(2)  The speaker of the House of Representatives, or his designee.
(3)  The president of the Senate or his designee.
(4)  The chair of the Senate Committee on Judiciary B or his designee.
(5)  The chair of the House Judiciary Committee or his designee.
(6)  The secretary of the Department of Revenue or his designee.
(7)  The chair of the House Ways and Means Committee or his designee.
(8)  The chair of the Senate Committee on Revenue and Fiscal Affairs or his
designee.
(9)  The president of the Louisiana Association of Tax Administrators, or his
designee who is a member of the association.
BE IT FURTHER RESOLVED that the task force shall meet as necessary and shall
report its findings and recommendations to the legislature not later than January 1, 2022, and
shall terminate upon the date of such report or January 1, 2022, whichever occurs first.
BE IT FURTHER RESOLVED that the office of alcohol and tobacco control shall
be responsible for designating staff of the office of alcohol and tobacco control to assist the
task force in performing its duties.
BE IT FURTHER RESOLVED that the Louisiana Direct-to-Consumer Wine Task
Force shall submit one print copy and one electronic copy of any report produced pursuant
to this Resolution to the David R. Poynter Legislative Research Library as required by R.S.
24:772.
BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the
commissioner of alcohol and tobacco control and the secretary of the Louisiana Department
of Revenue.
