HOUSE RESOLUTION NO. 148
BY REPRESENTATIVE IVEY
CRIMINAL/JUSTICE:  Requests the La. Sexual Assault Oversight Commission to study
and make recommendations concerning access by adult survivors of sexual assault
to their records related to forensic medical examinations
1	A RESOLUTION
2To urge and request the Louisiana Sexual Assault Oversight Commission to study the access
3 of adult sexual assault survivors to their records related to forensic medical
4 examinations and make recommendations to the Legislature of Louisiana no later
5 than February 1, 2022.
6 WHEREAS, the state of Louisiana shares a critical concern for survivors of sexual
7violence and a desire to support their needs for justice and healing; and
8 WHEREAS, according to the Centers for Disease Control and Prevention,
9approximately one in five women and one in seventy-one men have experienced rape in their
10lifetime; and
11 WHEREAS, rape is recognized as the most under-reported crime, and survivors of
12rape and other forms of sexual assault who do not report the crime still desire safety and
13protection from future interactions with the offender; and
14 WHEREAS, in order to access all forms of justice that may be available, survivors
15of sexual assault may need access to their records related to their forensic medical exams;
16and 
17 WHEREAS, there is a lack of a consistent process for survivors to access these
18records and, in some jurisdictions, medical facilities are withholding the ability for survivors
19to access their records.

1 THEREFORE, BE IT RESOLVED that the House of Representatives of the
2Legislature of Louisiana does hereby urge and request the Louisiana Sexual Assault
3Oversight Commission to study the impediments to access that adult survivors of sexual
4assault have to forensic medical examination records and propose recommendations to make
5these records accessible to survivors.   
6 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the
7chairman of the Louisiana Sexual Assault Oversight Commission.
8 BE IT FURTHER RESOLVED that one print copy and one electronic copy of any
9report produced pursuant to this Resolution shall be submitted to the David R. Poynter
10Legislative Research Library as required by R.S. 24:772.
