ENROLLED 2021 Regular Session HOUSE RESOLUTION NO. 148 BY REPRESENTATIVE IVEY A RESOLUTION To urge and request the Louisiana Sexual Assault Oversight Commission to study the access of adult sexual assault survivors to their records related to forensic medical examinations and make recommendations to the Legislature of Louisiana no later than February 1, 2022. WHEREAS, the state of Louisiana shares a critical concern for survivors of sexual violence and a desire to support their needs for justice and healing; and WHEREAS, according to the Centers for Disease Control and Prevention, approximately one in five women and one in seventy-one men have experienced rape in their lifetime; and WHEREAS, rape is recognized as the most under-reported crime, and survivors of rape and other forms of sexual assault who do not report the crime still desire safety and protection from future interactions with the offender; and WHEREAS, in order to access all forms of justice that may be available, survivors of sexual assault may need access to their records related to their forensic medical exams; and WHEREAS, there is a lack of a consistent process for survivors to access these records. THEREFORE, BE IT RESOLVED that the House of Representatives of the Legislature of Louisiana does hereby urge and request the Louisiana Sexual Assault Oversight Commission to study the impediments to access that adult survivors of sexual assault have to forensic medical examination records and propose recommendations to make these records accessible to survivors. Page 1 of 2 HR NO. 148 ENROLLED BE IT FURTHER RESOLVED that the Louisiana Sexual Assault Oversight Commission shall submit a written report to the Legislature of Louisiana detailing its findings and recommendations prior to February 1, 2022. BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the chairman of the Louisiana Sexual Assault Oversight Commission. BE IT FURTHER RESOLVED that one print copy and one electronic copy of any report produced pursuant to this Resolution shall be submitted to the David R.
