HLS 21RS-176 ORIGINAL 2021 Regular Session HOUSE STUDY REQUEST NO. 2 BY REPRESENTATIVE MCMAHEN MALPRACTICE/MEDICAL: Requests the Committee on Civil Law and Procedure to study modifications for certain time periods regarding medical malpractice claims, medical review panel composition, and compensation limitations 1 A STUDY REQUEST 2To the House Committee on Civil Law and Procedure to study modifications for certain time 3 periods regarding medical malpractice claims, medical review panel composition, 4 and compensation limitations, and to report its findings to the House of 5 Representatives prior to the convening of the 2022 Regular Session of the 6 Legislature of Louisiana. 7 WHEREAS, the law concerning medical malpractice claims against state and non- 8state medical service providers has remained largely untouched since first being passed in 91975; and 10 WHEREAS, there is a growth in the healthcare industry that could require 11adjustment to the medical malpractice laws; and 12 WHEREAS, as recently as 2014, there were more than one thousand six hundred 13requests for medical panel reviews in Louisiana; and 14 WHEREAS, there is a need from both healthcare providers and patients to study 15ways the law can be adapted to the modern status of health care in Louisiana; and 16 WHEREAS, in conducting the study hereby requested, the House Committee on 17Civil Law and Procedure may solicit input, recommendations, and advice from interested 18stakeholders including the division of administration, the Patient's Compensation Fund 19Oversight Board, the Louisiana State Medical Society, the Louisiana Medical Mutual 20Insurance Company, and the Louisiana State Board of Medical Examiners.
