(gov sig) 1 AN ACT 2 To amend and reenact R.S. 40:1281.26(C)(1) and to enact R.S. 40:1281.26(D), relative to 3 individual sewerage systems; to provide for a temporary waiver of sanitary code 4 requirements for individual sewerage systems in certain jurisdictions; to authorize 5 enforcement by the jurisdiction; to provide for exceptions; to provide for definitions; 6 and to provide for related matters. 7 Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 40:1281.26(C)(1) is hereby amended and reenacted and R.S. 9 40:1281.26(D) is hereby enacted to read as follows: 10 ยง1281.26. Individual sewerage systems; temporary waiver; enforcement 11 * * * 12 C. The parish or any municipality within the parish may provide appropriate 13 enforcement mechanisms to discourage citizens owning property within the 14 boundaries of the parish from doing any of the following: 15 (1) Connecting multiple habitable structures to an individual sewerage 16 system. However, two recreational vehicles, as defined in this Section, may 17 connect to one individual sewerage system. For the purposes of this Section, "recreational vehicle" means a 3 motorized or towable vehicle that combines transportation and temporary 4 living quarters including but not limited to motor homes, travel trailers, and 5 camping trailers. 6 Section 2. This Act shall become effective upon signature by the governor or, if not 7 signed by the governor, upon expiration of the time for bills to become law without signature 8 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 9 vetoed by the governor and subsequently approved by the legislature, this Act shall become 10 effective on the day following such approval. DIGEST SB 192 Engrossed 2021 Regular Session Hensgens Present law requires the Dept. of Health and Hospitals, office of public health, to temporarily waive applicable requirements of the state sanitary code regarding individual sewerage systems during the construction of a community sewerage system for properties located within the boundaries of any parish with a population between 6,800 and 6,900 according to the latest federal decennial census under certain conditions. Present law authorizes a parish or any municipality within the parish to provide appropriate enforcement mechanisms to discourage citizens owning property within the boundaries of the parish from certain actions, including connecting multiple habitable structures to an individual sewerage system. Proposed law provides an exemption for connecting two recreational vehicles to a single individual sewerage system from the actions local government may provide enforcement mechanisms against or may discourage. Proposed law provides a definition for recreational vehicle. Effective upon signature of the governor or lapse of time for gubernatorial action.
