(8/1/21) 1 AN ACT 2 To amend and reenact R.S. 37:3703(B)(3) and (4), relative to the membership of the 3 Louisiana Behavior Analyst Board; to provide for the length of an appointment term; 4 to provide for applicability; and to provide for related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 37:3703(B)(3) and (4) are hereby amended and reenacted to read as 7 follows: 8 ยง3703. Louisiana Behavior Analyst Board 9 * * * 10 B. * * * 11 (3) The governor shall ensure that his appointments demonstrate race, gender, 12 ethnic, and geographical diversity. Members of the board shall serve at the pleasure 13 of the governor. A vacancy in an unexpired term shall be filled in the manner of the 14 original appointment for the remainder of the unexpired term. 15 (4) Each member of the board shall be appointed for a term of four 16 years. No member of the board shall serve more than two consecutive complete 17 terms on the board. The provisions of Section 1 of this Act shall apply to the terms of the 3 members of the Louisiana Behavior Analyst Board currently serving on the effective date 4 of this Act. A board member's four-year term shall be considered to have begun on the date 5 the board member was officially appointed. DIGEST SB 38 Reengrossed 2021 Regular Session Foil Present law provides for the Louisiana Behavior Analyst Board (board) including the membership, officers, meetings, and powers and duties of the board. Proposed law retains present law. Present law provides that members of the board shall serve at the pleasure of the governor and a vacancy in an unexpired term shall be filled in the manner of the original appointment. Proposed law provides that each member of the board shall be appointed for a term of four years and that a vacancy in an unexpired term shall be filled in the manner of the original appointment for the remainder of the unexpired term. Proposed law applies to the terms of the members of the board appointed prior to the effective date of proposed law. Effective August 1, 2021.
