HEALTH DEPARTMENT.  Provides relative to telehealth services provided by licensed
hearing aid dealers. (8/1/21)
1	AN ACT
2 To amend and reenact R.S. 40:1223.3(3) and to enact R.S. 37:2457(11), relative to telehealth
3 services provided by licensed hearing aid dealers; to provide for inclusion in the
4 Louisiana Telehealth Access Act; to provide for powers and duties of the board; to
5 provide minimum standards for the provision of telehealth services; to provide for
6 definitions; and to provide for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 37: 2457(11) is hereby enacted to read as follows:
9 §2457. Powers and duties of board
10	The powers and duties of the Louisiana Board for Hearing Aid Dealers are
11 as follows:

13	(11) To promulgate rules for the provision of telehealth services by
14 licensed hearing aid dealers that, at a minimum, comply with the Louisiana
15 Telehealth Access Act, R.S. 40:1223.1 et seq.
16 Section 2.  R.S. 40:1223.3(3) is hereby amended and reenacted to read as follows:

2	(3) "Healthcare provider" means a person, partnership, limited liability
3 partnership, limited liability company, corporation, facility, or institution licensed
4 or certified by this state to provide healthcare or professional services as a physician
5 assistant, hospital, nursing home, dentist, registered nurse, advanced practice
6 registered nurse, licensed dietitian or nutritionist, licensed practical nurse, certified
7 nurse assistant, offshore health service provider, ambulance service, licensed
8 midwife, pharmacist, speech-language pathologist, audiologist, optometrist,
9 podiatrist, chiropractor, physical therapist, occupational therapist, certified or
10 licensed athletic trainer, psychologist, medical psychologist, social worker, licensed
11 professional counselor, licensed perfusionist, licensed respiratory therapist, licensed
12 radiologic technologist, licensed hearing aid dealer, or licensed clinical laboratory
13 scientist.

Present law provides for the Louisiana Telehealth Access Act which authorizes professional
or occupational licensing boards to promulgate rules necessary to provide for, promote, and
regulate the use of telehealth in the delivery of services and within the scope of practice of
the individual health care providers under their jurisdiction.
Proposed law retains present law and adds licensed hearing aid dealers to the definition of
health care provider included in the Louisiana Telehealth Access Act.
Present law provides for powers and duties of the Louisiana Board for Hearing Aid Dealers.
Proposed law retains present law and adds reference to the board's authority to promulgate
rules for the provision of telehealth services in accordance with the Louisiana Telehealth
Access Act.
Effective August 1, 2021.
