BESE.  Provides relative to the election districts for the State Board of Elementary and
Secondary Education. (Item #4)
1	AN ACT
2 To enact R.S. 17:2.2 and to repeal R.S. 17:2.1, relative to redistricting; to provide for
3 election districts for the State Board of Elementary and Secondary Education; to
4 provide for election of members; to provide for effectiveness; and to provide for
5 related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 17:2.2 is hereby enacted to read as follows:
8 §2.2.  Districts for election of members of the State Board of Elementary and
9	Secondary Education
10	Louisiana shall be divided into eight districts for the election of eight of
11 the members of the State Board of Elementary and Secondary Education. One
12 member shall be elected from each of the following districts:
13	(1)  District 1 is composed of Precincts 1, 2, 3, 4, 5, 7, 8, 9, 10, 11, 12, 13,
14 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, 36,
15 37, 38, 39, 40, 41, 42, 43, 44, 45, 46, 51, 52, 53, 54, 55, 56, 58, 59, 60, 61, 62, 63, 64,
16 65, 66, 67, 68, 69, 70, 71, 72, 73, 74, 75, 76, 77, 78, 79, 80, 81, 82, 83, 84, 85, 86, 87,

23 Section 2.  R.S. 17:2.1 is hereby repealed.
24 Section 3.(A) The precincts referenced in this Act are those precincts identified as
25 Voting Districts (VTDs) in the 2020 Census Redistricting TIGER/Line Shapefiles for the
26 State of Louisiana as validated through the data verification program of the Louisiana House
27 of Representatives and the Louisiana Senate and available on the legislature's website on the
28 effective date of this Section.
29 (B) When a precinct referenced in this Act has been subdivided by action of the

1 parish governing authority on a nongeographic basis or subdivided by action of the parish
2 governing authority on a geographic basis in accordance with the provisions of R.S.
3 18:532.1, the enumeration in this Act of the general precinct designation shall include all
4 nongeographic and all geographic subdivisions thereof, however such subdivisions may be
5 designated.
6 (C)  The territorial limits of the districts as provided in this Act shall continue in
7 effect until changed by law regardless of any subsequent change made to the precincts by
8 the parish governing authority.
9 Section 4.(A)  Solely for the purposes of qualifying for election and the election of
10 members of the State Board of Elementary and Secondary Education at the regularly
11 scheduled elections in 2023, the provisions of Section 1 of this Act shall become effective
12 upon signature of this Act by the governor or, if not signed by the governor, upon expiration
13 of the time for bills to become law without signature by the governor, as provided in Article
14 III, Section 18 of the Constitution of Louisiana. If this Act is vetoed by the governor and
15 subsequently approved by the legislature, the provisions of Section 1 of this Act shall
16 become effective on the day following such approval for the purposes established in this
17 Subsection.
18 (B)  The provisions of Section 1 of this Act shall be effective for all other purposes
19 at noon on January 8, 2024.
20 (C)  Section 2 of this Act shall become effective at noon on January 8, 2024.
21 (D)  The provisions of this Section and Section 3 of this Act shall become effective
22 upon signature of this Act by the governor or, if not signed by the governor, upon expiration
23 of the time for bills to become law without signature by the governor, as provided in Article
24 III, Section 18 of the Constitution of Louisiana. If this Act is vetoed by the governor and
25 subsequently approved by the legislature, the provisions of this Section and Section 3 of this
26 Act shall become effective on the day following such approval.

Present constitution (Const. Art. VIII, §3(B)) provides that BESE is composed of 11members, eight of whom are elected from single-member districts and three of whom areappointed by the governor from the state at large.
Proposed law redraws district boundaries for the eight BESE districts, effective uponsignature of the governor or lapse of time for gubernatorial action for purposes of the 2023election.
Proposed law retains present districts until noon, January 8, 2024, at which time present lawis repealed and proposed districts are effective for all other purposes.
Proposed law specifies that precincts referenced in district descriptions are those precinctsidentified as Voting Districts (VTDs) in the 2020 Census Redistricting TIGER/LineShapefiles for the state of La. as validated through the data verification program of the La.legislature. Also specifies that if any such precinct has been subdivided by action of theparish governing authority on a nongeographic basis or subdivided by action of the parish
governing authority on a geographic basis in accordance with present law, the enumerationof the general precinct designation shall include all nongeographic and all geographicsubdivisions thereof. Further provides that the territorial limits of the districts as enactedshall continue in effect until changed by law regardless of any subsequent change made tothe precincts by the parish governing authority.

statistical information, and maps are supplied for purposes of information and analysis and
comprise no part of proposed law.
Effective for election purposes only for the regular BESE elections in 2023; effective for all
other purposes at noon, January 8, 2024.
