HLS 22RS-432 ORIGINAL 2022 Regular Session HOUSE BILL NO. 1031 BY REPRESENTATIVE FREIBERG MOTOR VEHICLES: Imposes a road usage fee on certain electric and hybrid vehicles 1 AN ACT 2To enact Part II-A of Chapter 3 of Title 32 of the Louisiana Revised Statutes of 1950, to be 3 comprised of R.S. 32:461, relative to a yearly road usage fee on certain vehicles; to 4 levy a road usage fee on electric and hybrid motor vehicles; to provide for the 5 collection and disposition of the proceeds; to provide for certain definitions; to 6 provide for the use of road usage fee proceeds; and to provide for related matters. 7Be it enacted by the Legislature of Louisiana: 8 Section 1. Part II-A of Chapter 3 of Title 32 of the Louisiana Revised Statutes of 91950, comprised of R.S. 32:461, is hereby enacted to read as follows: 10 PART II-A. ELECTRIC VEHICLES AND HYBRID VEHICLES 11 ยง461. Imposition of road usage fee; electric vehicles; hybrid vehicles; collection; 12 use of proceeds 13 A.(1) There is hereby levied a road usage fee of four hundred dollars per 14 year on each electric vehicle which is operated upon the highways of this state and 15 which is required to be registered and to pay the vehicle registration license tax in 16 accordance with the provisions of Chapter 4 of Subtitle II of Title 47 of the 17 Louisiana Revised Statutes of 1950. 18 (2) There is hereby levied a road usage fee of two hundred seventy-five 19 dollars per year on each hybrid vehicle which is operated upon the highways of this 20 state and which is required to be registered and to pay a vehicle registration license Page 1 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HLS 22RS-432 ORIGINAL HB NO. 1031 1 tax in accordance with the provisions of Chapter 4 of Subtitle II of Title 47 of the 2 Louisiana Revised Statutes of 1950. 3 B. For purposes of this Section, the following terms shall have the following 4 meanings unless the context clearly indicates otherwise: 5 (1) "Electric vehicle" shall mean a vehicle which is powered by one or more 6 electric motors or energy stored in rechargeable batteries for propulsion. 7 (2) "Hybrid vehicle" shall mean a vehicle that uses gasoline, diesel fuel, or 8 special fuels in combination with an electric motor for propulsion. 9 C. The commissioner of the office of motor vehicles shall collect the fee 10 levied pursuant to the provisions of this Section every two years at the same time and 11 in the same manner as the vehicle registration license tax collected pursuant to the 12 provisions of R.S. 47:463. 13 D. The Department of Transportation and Development shall utilize one 14 hundred percent of the road usage fee levied on electric and hybrid vehicles for 15 highway and bridge preservation projects included in the Highway Priority Program 16 in accordance with the Department of Transportation and Development's definitions 17 of such projects. The total cost of a preservation project shall include the prorated 18 cost associated with third-party services required by the department to create, 19 implement, and maintain an online platform pursuant to the provisions of R.S. 20 48:229.1. Proposed law levies a road usage fee of $400 per year on each electric vehicle and an annual road usage fee of $275 per year on each hybrid vehicle operated on state highways which are required to be registered and to pay a vehicle registration license tax in accordance with present law. Further requires the commissioner of the office of motor vehicles to collect the tax levied in proposed law every two years at the same time and in the same manner as the registration license tax pursuant to present law.
