Louisiana House Bill HB134 Comm Sub / Analysis

                    RÉSUMÉ DIGEST
ACT 33 (HB 134) 2022 Regular Session	Marino
Existing law provides for the crime of false statements and false or altered documents.
Provides that any person who commits the existing law crime shall be imprisoned with or
without hard labor for not more than five years, or fined not more than $10,000, or both.
New law retains existing law.
Prior law required any person convicted of the crime of false statements and false or altered
documents to make full restitution to the Dept. of Treasury to be deposited in the La.
Unclaimed Property Permanent Trust Fund. If the person ordered to make restitution was
found to be indigent and unable to make restitution in full at the time of conviction, the court
was required to order a periodic payment plan consistent with the person's financial ability.
New law provides that restitution shall be ordered according to existing law (C.Cr.P. Art.
883.2) and shall be made payable to the La. Unclaimed Property Permanent Trust Fund.
Effective August 1, 2022.
