CONTRACTS/BIDS: Provides relative to procurement limits for purchases of materials and
supplies by public entities
1 AN ACT
2To amend and reenact R.S. 38:2212.1(A)(1)(a) and (b), relative to certain purchases of
3 materials or supplies paid by public funds and publicly bid; to increase the
4 purchasing limit for materials and supplies; to increase the purchasing range
5 requiring quotes for the purchase file; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 38:2212.1(A)(1)(a) and (b) are hereby amended and reenacted to read
8as follows:
9 ยง2212.1. Advertisement and letting to lowest responsible bidder; materials and
10 supplies; exemptions
11 A.(1)(a) All purchases of any materials or supplies exceeding the sum of
12 thirty sixty thousand dollars to be paid out of public funds shall be advertised and let
13 by contract to the lowest responsible bidder who has bid according to the
14 specifications as advertised, and no such purchase shall be made except as provided
15 in this Part.
16 (b) However, purchases of ten twenty thousand dollars or more, but less than
17 thirty sixty thousand dollars, shall be made by obtaining not less than three quotes
18 by telephone, facsimile, email, or any other printable electronic form. If telephone
19 quotes are received, a written confirmation of the accepted offers shall be obtained

1 and made a part of the purchase file. If quotations lower than the accepted quotation
2 are received, the reasons for their rejection shall be recorded in the purchase file.

Abstract: Increases the purchasing limit for materials and supplies, and increases the
purchasing range requiring quotes for public bids paid out of public funds.
Present law requires all purchases of materials or supplies exceeding the sum of $30,000
paid out of public funds be advertised and let by contract to the lowest responsible bidder
who has bid according to specifications advertised. Requires no purchase be made except
as provided in present law.
Proposed law modifies present law by increasing the purchasing limit for materials and
supplies from $30,000 to $60,000.
Present law requires purchases of $10,000 or more, but less than $30,000 be made by
obtaining not less than three quotes by telephone, facsimile, email, or any other printable
electronic form. Requires written confirmation for accepted offers be obtained and made
a part of the purchase file for telephone quotes. Requires the reasons for rejected offers be
recorded in the purchase file for quotes lower than the accepted quotes.
Proposed law modifies present law by increasing the purchasing range requiring quotes for
the purchase file from $10,000 or more but less than $30,000 to $20,000 or more but less
than $60,000.
