HOUSE BILL NO. 238
BY REPRESENTATIVE ORGERON
EDUCATION/SPECIAL:  Provides relative to the membership of the board of
commissioners of Special Education District No. 1 of the parish of Lafourche
1	AN ACT
2To amend and reenact Section 2 of Act No. 569 of the 1976 Regular Session of the
3 Louisiana Legislature, as amended and reenacted by Act No. 622 of the 1980
4 Regular Session of the Louisiana Legislature and Act 462 of the 1989 Regular
5 Session of the Louisiana Legislature, relative to Special Education District No. 1 of
6 the parish of Lafourche; to provide relative to the membership of the district's board
7 of commissioners; to provide for the method of appointment; and to provide for
8 related matters.
9	Notice of intention to introduce this Act has been published
10	as provided by Article III, Section 13 of the Constitution of
11	Louisiana.
12Be it enacted by the Legislature of Louisiana:
13 Section 1.  Section 2 of Act No. 569 of the 1976 Regular Session of the Louisiana
14Legislature, as amended and reenacted by Act No. 622 of the 1980 Regular Session of the
15Louisiana Legislature and Act No. 462 of the 1989 Regular Session of the Louisiana
16Legislature, is hereby amended and reenacted to read as follows:
17 Section 2.  The powers of the district and the control and management of the affairs
18of the district shall be vested in a board of commissioners to be composed of seven qualified
19electors residing within the limits of the district.  The initial members of the board and their
20successors, who shall serve without compensation, shall be appointed as follows:

1	(1)  Three Four commissioners shall be appointed by the Lafourche Parish
2 School Board from a panel of six names submitted by the members of the Lafourche
3 Parish School Board elected from the geographic area comprising Ward Ten of
4 Lafourche Parish the district.  One commissioner shall be appointed by the
5 Lafourche Parish School Board from among the members in good standing of the
6 organization, Friends of the Center.
7	(2)  Two Three commissioners shall be appointed by the parish governing
8 authority from a panel of four names submitted by the members of the parish
9 governing authority elected from the geographic area comprising Ward Ten of
10 Lafourche Parish the district.  One commissioner shall be appointed by the parish
11 governing authority from among the members in good standing of the organization,
12 Friends of the Center.
13	(3)  The commissioners shall serve terms of six years each; provided
14 however, that the term of any commissioner shall terminate and his office shall
15 become vacant ipso facto upon such commissioner's failure to attend three
16 consecutive regular monthly meetings of the board, and the vacancy in such office
17 shall be filled in the manner provided for in Paragraphs (1) or (2) of this Section by
18 the Lafourche Parish School Board or the parish governing authority whichever
19 appointed the commissioner whose office has been vacated as provided for herein.

Abstract:  Revises the manner of appointment of members of the board of commissioners
of Special Education District No. 1 of Lafourche Parish.
Present law creates and provides for Special Education District No. 1 of the parish of
Lafourche.  (It operates a facility known as "the Center" for individuals with disabilities.)
Provides for governance by a board of seven commissioners.  Proposed law retains present
law but changes the manner of appointment of the commissioners as follows:
(1)Present law provides for four commissioners to be appointed by the parish school
board.  Proposed law retains this number of appointments but revises the method of
appointment as follows:

(a)Requires three appointments from a list of six names submitted by members
elected from the area comprising the district.  Proposed law increases this
number of appointees from three to four and removes the specific number of
names that school board members shall submit.
(b)Requires the appointment of one commissioner from among the members in
good standing with Friends of the Center.  Proposed law removes present
law.
(2)Present law provides for three commissioners to be appointed by the parish
governing authority.  Proposed law retains this number of appointments but revises
the method of appointment as follows:
(a)Present law provides for two commissioners to be appointed from a list of
four names submitted by members elected from the area comprising the
district.  Proposed law increases this number of appointees from two to three
and removes the specific number of names that parish governing authority
members shall submit.
(b)Present law requires the appointment of one commissioner from among the
members in good standing with Friends of the Center.  Proposed law
removes present law.
