HOUSE BILL NO. 252

ADOPTION:  Provides relative to venue and jurisdiction in adoption
1	AN ACT
2To amend and reenact Children's Code Article 1180(A), relative to adoption; to provide for
3 venue for adoptions; and to provide for related matters.
4Be it enacted by the Legislature of Louisiana:
5 Section 1.  Children's Code Article 1180(A) is hereby amended and reenacted to read
6as follows: 
7 Art. 1180.  Venue and jurisdiction in adoption
8	A.  A proceeding for the adoption of a child may be commenced in either:
9	(1)  The juvenile court in the parish of the domicile of the petitioner.
10	(2)  The juvenile court in the parish of the domicile of the custodian of the
11 child.
12	(3)  The juvenile court in the parish in which a voluntary act of surrender has
13 been executed with respect to the child to be adopted.
14	(4)  The juvenile court in which the child has been adjudicated a child in need
15 of care or in which the child in need of care proceeding is pending.
16	(5) (4)  The juvenile court which previously terminated parental rights of a
17 parent with respect to the child to be adopted.

Abstract:  Removes the juvenile court in the parish where the act of surrender was executed
as a potential venue for child adoptions.
Present law provides that venues for child adoptions be in the juvenile court in the parish of
any of the following:
(1)Petitioner's domicile.
(2)Custodian of the child's domicile.
(3)Location where the voluntary act of surrender was executed.
(4)Location where the child in need of care proceeding is pending or adjudicated.
(5)Location where the parental rights of a parent of the adopted child were terminated.
Proposed law removes the juvenile court in the parish where the act of surrender was
executed as a potential venue.

Summary of Amendments Adopted by House
The House Floor Amendments to the engrossed bill:
1. Restore the juvenile court in the parish where the parental rights of a parent of
the adopted child were terminated as an eligible venue for child adoptions.
