HOUSE BILL NO. 31

RETIREMENT/STATE SYSTEMS:  (Constitutional Amendment) Dedicates a certain
amount of state nonrecurring revenue to state retirement systems for supplemental
benefit payments
1	A JOINT RESOLUTION
2Proposing to add Article VII, Section 10(D)(2)(g) of the Constitution of Louisiana, to
3 require the use of nonrecurring revenue to make supplemental benefit payments to
4 retirees, beneficiaries, or survivors of state retirement systems; to provide for the
5 amount of such lump sum payments; to provide for submission of the proposed
6 amendment to the electors; and to provide for related matters.
7	Notice of intention to introduce this Act has been published
8	as provided by Article III, Section 13 and Article X, Section
9	29(C) of the Constitution of Louisiana.
10 Section 1.  Be it resolved by the Legislature of Louisiana, two-thirds of the members
11elected to each house concurring, that there shall be submitted to the electors of the state of
12Louisiana, for their approval or rejection in the manner provided by law, a proposal to add
13Article VII, Section 10(D)(2)(g) of the Constitution of Louisiana, to read as follows:

1	(2)  Except as otherwise provided in this constitution, the appropriation or
2 allocation of any money designated in the official forecast as nonrecurring shall be
3 made only for the following purposes:

5	(g)  For Fiscal Year 2023-2024 and each fiscal year thereafter, the legislature
6 shall appropriate to the state retirement systems a total of either fifty million dollars
7 or the balance of nonrecurring funds after allocations are made pursuant to
8 Subsubparagraphs (b) and (d) of this Paragraph, whichever is less.  The funds shall
9 be used to make nonrecurring lump sum payments to eligible recipients.  The amount
10 of the payment shall be calculated by dividing the total appropriated amount by the
11 total number of eligible recipients.  For the purposes of this Subsubparagraph, the
12 term "eligible recipients" means retirees, beneficiaries, and survivors who were
13 receiving benefits from the system as of June 30 of the prior fiscal year.  The
14 legislature may provide by law for certification to the legislature of the number of
15 eligible recipients there are in each system and the total number of eligible recipients
16 pursuant to the provisions of this Subsubparagraph.

18 Section 2.  Be it further resolved that this proposed amendment shall be submitted
19to the electors of the state of Louisiana at the statewide election to be held on November 8,
202022.
21 Section 3.  Be it further resolved that on the official ballot to be used at the election,
22there shall be printed a proposition, upon which the electors of the state shall be permitted
23to vote YES or NO, to amend the Constitution of Louisiana, which proposition shall read as
24follows:
25	Do you support an amendment to require that some nonrecurring state
26	revenue be used to pay supplemental retirement benefits to retired state
27	government and school board employees and their beneficiaries and

Abstract:  Requires the use of nonrecurring state revenue for supplemental benefit
payments to retirees, beneficiaries, and survivors of the four state retirement systems.
Present constitution limits the ability of the legislature to spend state nonrecurring revenue
to particular items.  Proposed constitutional amendment retains present constitution.
Proposed constitutional amendment requires that some nonrecurring revenue be paid to
retirees, beneficiaries, and survivors receiving a benefit, from the four state retirement
systems: La. State Employees' Retirement System, Teachers' Retirement System of La., La.
School Employees' Retirement System, and the La. State Police Retirement System.
Proposed constitutional amendment provides that the amount to be used for such
supplemental retirement benefits is the lesser of $50 million or the balance of nonrecurring
revenue after allocations are made for payments against retirement system liabilities and for
the Budget Stabilization Fund.
Proposed constitutional amendment provides the retiree, beneficiary, or survivor must have
been receiving a benefit by June 30 of the previous fiscal year in order to be eligible for the
lump sum payment.
Provides for submission of the proposed amendment to the voters at the statewide election
to be held November 8, 2022.
