ACT 45 (HB 322) 2022 Regular Session	Marino
Existing law provides for the crime of simple criminal damage to property.  Provides that
simple criminal damage to property is the intentional damaging of any property of another,
without the consent of the owner, by any means other than fire or explosion.
Existing law provides for punishment:
(1)When the damage amounts to less than $1,000, the offender shall be fined up to
$1,000 or imprisoned for up to six months, or both.
(2)When the damage amounts to between $1,000 and $50,000, the offender shall be
fined up to $1,000 or imprisoned for up to two years, or both.
(3)When the damage amounts to over $50,000 or more, the offender shall be fined up
to $10,000 or imprisoned between one and 10 years, or both.
Existing law provides that a person convicted under existing law may be ordered to make full
restitution to the owner of the property.
New law retains existing law but adds that in the case of damage to multiple properties by
an offender's distinct acts as part of a continuous sequence of events, the amount of damages
shall determine the grade of the offense.
Effective August 1, 2022.
