HOUSE BILL NO. 371

CRIME:  Amends the definition of "police officer" for the crimes of battery of a police
officer and resisting a police officer with force or violence
1	AN ACT
2To amend and reenact R.S. 14:34.2(A)(2) and 108.2(B), relative to offenses against law
3 enforcement; to provide relative to the definition "police officer" for the crimes of
4 battery of a police officer and resisting a police officer with force or violence; to add
5 juvenile detention facility officers to the definitions of "police officer"; and to
6 provide for related matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 14:34.2(A)(2) and 108.2(B) are hereby amended and reenacted to
9read as follows: 
10 §34.2.  Battery of a police officer

13	(2)  For purposes of this Section, "police officer" shall include commissioned
14 police officers, sheriffs, deputy sheriffs, marshals, deputy marshals, correctional
15 officers, juvenile detention facility officers, federal law enforcement officers,
16 constables, wildlife enforcement agents, state park wardens, and probation and
17 parole officers.

1	B.  For purposes of this Section, "police officer" shall include any
2 commissioned police officer, sheriff, deputy sheriff, marshal, deputy marshal,
3 correctional officer, juvenile detention facility officer, constable, wildlife
4 enforcement agent, state park warden, or probation and parole officer.

detention facility officers.
Present law provides for the crime of battery of a police officer.
Present law defines "police officer" to include commissioned police officers, sheriffs, deputy
sheriffs, marshals, deputy marshals, correctional officers, federal law enforcement officers,
constables, wildlife enforcement agents, state park wardens, and probation and parole
officers.
Proposed law adds juvenile detention facility officers to the present law definition of "police
officer".
Present law provides for the crime of resisting a police officer with force or violence.
Present law defines "police officer" to include any commissioned police officer, sheriff,
deputy sheriff, marshal, deputy marshal, correctional officer, constable, wildlife enforcement
