HOUSE BILL NO. 378

DRUGS/CONTROLLED:  Adds certain substances to the Uniform Controlled Dangerous
Substances Law
AN ACT1
To amend and reenact R.S. 40:964(Schedule II)(A)(1)(introductory paragraph) and to enact2
R.S. 40:964(Schedule I)(A)(80) through (99), (C)(66), (E)(12), and (F)(29), and3
(Schedule IV)(D)(15), relative to the Uniform Controlled Dangerous Substances4
Law; to add certain substances to Schedules I and IV; to provide relative to 5
substances of vegetable origin or chemical synthesis in Schedule II; and to provide6
for related matters.7
Be it enacted by the Legislature of Louisiana:8
Section 1.  R.S. 40:964(Schedule II)(A)(1)(introductory paragraph) is hereby9
amended and reenacted and R.S. 40:964(Schedule I)(A)(80) through (99), (C)(66), (E)(12),10
and (F)(29), and (Schedule IV)(D)(15) are hereby enacted to read as follows: 11
§964.  Composition of schedules12
Schedules I, II, III, IV, and V shall, unless and until added to pursuant to R.S.13
40:962, consist of the following drugs or other substances, by whatever official14
name, common or usual name, chemical name, or brand name designated:15

A.  Opiates.  Unless specifically excepted or unless listed in another schedule,17
any of the following opiates, including their isomers, esters, ethers, salts, or salts of18
isomers, esters, and ethers, whenever the existence of such isomers, esters, ethers,19

C.  Hallucinogenic substances.  Unless specifically excepted or unless listed12
in another schedule, any material, compound, mixture, or preparation, which13
contains any quantity of the following hallucinogenic substances, or which contains14
any of their salts, isomers, or salts of isomers, whenever the existence of such salts,15
isomers, or salts of isomers is possible within the specific chemical designation, for16
purposes of this Paragraph only, the term "isomer" includes the optical, position, and17
geometric isomers:18

E.  Stimulants.  Unless specifically excepted, or contained within a22
pharmaceutical product approved by the United States federal Food and Drug23
Administration, or unless listed in another schedule, any material, compound,24
mixture, or preparation which contains any quantity of the following substances25
having a stimulant effect on the central nervous system including its salts, isomers,26
esters, or ethers and salts of isomers, esters, or ethers whenever the existence of such 27

salts, isomers, esters, or ethers and salts of isomers, esters, or ethers is possible1
within the specific chemical designation:2

F.  Synthetic cannabinoids. Unless specifically excepted, or contained within5
a pharmaceutical product approved by the United States Food and Drug6
Administration, or unless listed in another schedule, any material, compound,7
mixture, or preparation, which contains any quantity of a synthetic cannabinoid8
found to be in any of the following individual compounds or chemical groups, or any9
of those individual compounds or groups which contain any synthetic cannabinoid10
salts, isomers, salts of isomers, or nitrogen-heterocyclic analogs, whenever the11
existence of such salts, isomers, salts of isomers, or  nitrogen-heterocyclic analogs12
is possible within the specific compounds or chemical groups:13

A. Substances of vegetable origin or chemical synthesis. Unless specifically19
excepted or unless listed in another schedule, any of the following substances20
whether produced directly or indirectly by extraction from substances of vegetable21
origin, or independently by means of chemical synthesis, or by a combination of22
extraction and chemical synthesis:23
(1) Opium and opiate, and any salt, compound, derivative, or preparation of24
opium or opiate, excluding apomorphine, thebaine-derived butorphanol, dextrorphan,25
nalbuphine, naldemedine, nalmefene, naloxegol, naloxone, 6â-naltrexol, and26
naltrexone, and samidorphan, and their respective salts, but including the following:27

Section 2.  The Louisiana State Law Institute is hereby authorized and directed to8
renumber the substances in R.S. 40:964(Schedule I)(A),(C), and (E) and (Schedule V)(D)9
to ensure that such substances are in alphabetical order.10

Abstract:  Adds certain substances to Schedules I, II, and IV of the Uniform Controlled
Dangerous Substances Law.
Present law provides for the designation of controlled dangerous substances into Schedules
I, II, III, IV, and V based upon the substances' potential for addiction and abuse.
Proposed law adds 24 additional substances to Schedule I and Serdexmethylphenidate to
Schedule IV.
Proposed law adds samidorphan as a Schedule II substance of vegetable origin.

Summary of Amendments Adopted by House
The Committee Amendments Proposed by House Committee on Administration of
Criminal Justice to the original bill:
1. Add the chemical names to the proposed law substances listed in Schedule I.
2. Remove seven proposed law substances from Schedule I.
