FUNDS/FUNDING:  Provides for the transfer, deposit, and use of monies among state funds
1	AN ACT
2To amend and reenact R.S. 39:100.52(C) and to enact R.S. 39:100.52(D), Subpart Q-2 of
3 Part II-A of Chapter 1 of Subtitle I of Title 39 of the Louisiana Revised Statutes of
4 1950, to be comprised of R.S. 39:100.123, Subpart Q-3 of Part II-A of Chapter 1 of
5 Subtitle I of Title 39 of the Louisiana Revised Statutes of 1950, to be comprised of
6 R.S. 39:100.124, Subpart Q-4 of Part II-A of Chapter 1 of Subtitle I of Title 39 of the
7 Louisiana Revised Statutes of 1950, to be comprised of R.S. 39:100.125, Subpart S
8 of Part II-A of Chapter 1 of Subtitle I of Title 39 of the Louisiana Revised Statutes
9 of 1950, to be comprised of R.S. 39:100.146, Subpart V of Part II-A of Chapter 1 of
10 Subtitle I of Title 39 of the Louisiana Revised Statutes of 1950, to be comprised of
11 R.S. 39:100.171, and Subpart W of Part II-A of Chapter 1 of Subtitle I of Title 39 of
12 the Louisiana Revised Statutes of 1950, to be comprised of R.S. 39:100.181, relative
13 to certain treasury funds; to provide for the transfer, deposit, and use, as specified,
14 of monies in certain treasury funds and accounts; to provide an effective date; and
15 to provide for related matters.
16Be it enacted by the Legislature of Louisiana:
17 Section 1.(A)  Notwithstanding any provision of law to the contrary, the state
18treasurer is hereby authorized and directed to transfer $174,804,933, to be comprised wholly
19of nonrecurring revenues out of the State General Fund from the Fiscal Year 2020-2021

1surplus, as recognized by the Revenue Estimating Conference, to the Budget Stabilization
2Fund.
3 (B)  Notwithstanding any provision of law to the contrary, the state treasurer is
4hereby authorized and directed to transfer $152,818,325, to be comprised wholly of
5nonrecurring revenues out of the State General Fund from the Fiscal Year 2020-2021
6surplus, as recognized by the Revenue Estimating Conference, to the Capital Outlay Savings
7Fund.
8 Section 2.(A)  Notwithstanding any provision of law to the contrary, the state
9treasurer is hereby authorized and directed to transfer $10,000,000 from the State General
10Fund (Direct) into the Louisiana Outdoors Forever Fund contingent upon the Act which
11originated as House Bill No. 762 of this 2022 Regular Session of the Legislature becoming
12law.
13 (B)  Notwithstanding any provision of law to the contrary, the state treasurer is
14hereby authorized and directed to transfer $134,832 from the Conservation Fund to the Crab
15Development, Management, and Derelict Crab Trap Removal Account.
16 (C)  Notwithstanding any provision of law to the contrary, the state treasurer is
17hereby authorized and directed to transfer $3,250,965 from the Conservation Fund to the
18Oyster Resource Management Account.
19 (D) Notwithstanding any provision of law to the contrary, the state treasurer is hereby
20authorized and directed to transfer $6,000,000 from the State General Fund (Direct) to the
21Higher Education Initiatives Fund.
22 (E)  Notwithstanding any provision of law to the contrary, the state treasurer is
23hereby authorized and directed to transfer $135,000,000 from the State General Fund
24(Direct) to the Self-Insurance Fund.
25 (F)  Notwithstanding any provision of law to the contrary, the state treasurer is
26hereby authorized and directed to transfer $40,000,000 from the State General Fund (Direct)
27to the Louisiana Early Childhood Education Fund.
28 (G)  Notwithstanding any provision of law to the contrary, the state treasurer is
29hereby authorized and directed to transfer $86,741,864 from the Louisiana Coronavirus

1Capital Projects Fund to the Granting Unserved Municipalities Broadband Opportunities
2(GUMBO) Fund.
3 (H)  Notwithstanding any provision of law to the contrary, the state treasurer is
4hereby authorized and directed to transfer $25,000,000 from the Louisiana Rescue Plan Fund
5to the Workforce Training Rapid Response Fund for expanding healthcare workforce
6training programs in FY 23.
7 (I)  Notwithstanding any provision of law to the contrary, the state treasurer is hereby
8authorized and directed to transfer $45,000,000 from the State General Fund (Direct) to the 
9Jean Boudreaux Settlement Compromise Fund.
10 (J)  Notwithstanding any provision of law to the contrary, the state treasurer is hereby
11authorized and directed to transfer $500,000 from the Louisiana Rescue Plan Fund into the
12Small Business Innovation Recruitment Fund contingent upon the Act that originated as
13House Bill No. 795 of this 2022 Regular Session of the Legislature becoming law. 
14 (K)  Notwithstanding any provision of law to the contrary, the state treasurer is
15hereby authorized and directed to transfer $150,000 from the Louisiana Rescue Plan Fund
16into the Small Business Innovation Fund contingent upon the Act that originated as House
17Bill No. 796 of this 2022 Regular Session of the Legislature becoming law. 
18 (L)  Notwithstanding any provision of law to the contrary, the state treasurer is
19hereby authorized and directed to transfer $1,105,000 from the Louisiana Rescue Plan Fund
20into the Small Business Innovation Retention Fund contingent upon the Act that originated
21as House Bill No. 786 of this 2022 Regular Session of the Legislature becoming law.
22 (M)  Notwithstanding any provision of law to the contrary, the state treasurer is
23hereby authorized and directed to transfer $450,000,000 from the Louisiana Rescue Plan
24Fund into the Water Sector Fund.
25 (N)  Notwithstanding any provision of law to the contrary, the state treasurer is
26hereby authorized and directed to transfer $805,843 from the Louisiana Main Street
27Recovery Rescue Plan Fund to the Louisiana Rescue Plan Fund.

1 (O)  Notwithstanding any provision of law to the contrary, the state treasurer is
2hereby authorized and directed to transfer $5,000,000 from the State General Fund (Direct)
3to the Engineering Fee Subfund of the Water Sector Fund, as established in this Act.
4 (P)  Notwithstanding any provision of law to the contrary, the state treasurer is
5hereby authorized and directed to transfer $500,000,000 from the State General Fund
6(Direct) to the Revitalizing and Developing Infrastructure in All of Louisiana Fund, as
7established in this Act.
8 (Q)  Notwithstanding any provision of law to the contrary, the state treasurer is
9hereby authorized and directed to transfer $27,000,000 from the Louisiana Rescue Plan Fund
10to the Early Childhood Supports and Services Program Fund, as established in this Act.
11 (R)  Notwithstanding any provision of law to the contrary, the state treasurer is
12hereby authorized and directed to transfer $23,699,098 from the Louisiana Rescue Plan Fund
13to the Matching Funds Fund, as established in this Act.
14 (S)  Notwithstanding any provision of law to the contrary, the state treasurer is
15authorized and directed to transfer $5,000,000 from the State General Fund (Direct) to the
16Geaux Teach Fund contingent upon the Act that originated as House Bill No. 346 of the
172022 Regular Session of the Legislature becoming law.
18 (T)  Notwithstanding any provision of law to the contrary, the state treasurer is
19hereby authorized and directed to transfer $8,020,902 from the Louisiana Rescue Plan Fund
20to the Rural Primary Care Physicians Development Fund, as established in this Act.
21 (U)  Notwithstanding any provision of law to the contrary, the state treasurer is
22hereby authorized and directed to transfer $83,491,947 from the State General Fund (Direct)
23to the Capital Outlay Savings Fund.
24 (V)  Notwithstanding any provision of law to the contrary, the state treasurer is
25hereby authorized and directed to transfer $3,000,000 from the Louisiana Rescue Plan Fund
26to the Continuum of Care Fund, as established in this Act, contingent upon the Act that
27originated as House Bill No. 909 of the 2022 Regular Session of the Legislature becoming
28law.

1 Section 3.(A)  Notwithstanding any provision of law to the contrary, the state
2treasurer is hereby authorized and directed to transfer $42,500,000 from the State General
3Fund (Direct) to the Construction Subfund of the Transportation Trust Fund.
4 (B)  Notwithstanding any provision of law to the contrary, the state treasurer is
5hereby authorized and directed to transfer $30,000,000 from the State General Fund (Direct)
6to the Jean Boudreaux Settlement Compromise Fund.
7 (C)  Notwithstanding any provision of law to the contrary, the state treasurer is
8hereby authorized and directed to transfer $33,000,000 from the State General Fund (Direct)
9to the Hurricane Ida Recovery Fund, as established in this Act.
10 Section 4.  R.S. 39:100.52(C) is hereby amended and reenacted and R.S.
1139:100.52(D), Subpart Q-2 of Part II-A of Chapter 1 of Subtitle I of Title 39 of the Louisiana
12Revised Statutes of 1950, comprised of R.S. 39:100.123, Subpart Q-3 of Part II-A of Chapter
131 of Subtitle I of Title 39 of the Louisiana Revised Statutes of 1950, comprised of R.S.
1439:100.124, Subpart Q-4 of Part II-A of Chapter 1 of Subtitle I of Title 39 of the Louisiana
15Revised Statutes of 1950, comprised of R.S. 39:100.125, and Subpart S of Part II-A of
16Chapter 1 of Subtitle I of Title 39 of the Louisiana Revised Statutes of 1950, comprised of
17R.S. 39:100.146, Subpart V of Part II-A of Chapter 1 of Subtitle I of Title 39 of the
18Louisiana Revised Statutes of 1950, comprised of R.S. 39:100.171, and Subpart W of Part
19II-A of Chapter 1 of Subtitle I of Title 39 of the Louisiana Revised Statutes of 1950,
20comprised of R.S. 39:100.181, are hereby enacted to read as follows:
21 §100.52.  Water Sector Fund
22	*          *          *
23	C.  Monies in the fund shall be used to provide grant funding for repairs,
24 improvements, and consolidation of water systems and sewerage sewer systems and
25 repairs and improvements necessitated by storm water pursuant to the Water Sector
26 Program as provided in R.S. 39:100.56. 
27	D.  The Engineering Fee Subfund, hereafter referred to in this Section as the
28 subfund, is hereby created in the state treasury as a subfund in the Water Sector
29 Fund.  Monies appropriated or transferred to the subfund shall be deposited by the

1 state treasurer after compliance with the provisions of Article VII, Section 9(B) of
2 the Constitution of Louisiana.  Monies in the subfund shall be invested in the same
3 manner as monies in the Water Sector Fund, and any interest earned on the
4 investment of subfund monies shall be credited to the subfund.  All unexpended and
5 unencumbered monies in the subfund at the end of the fiscal year shall remain in the
6 subfund.  Monies in the subfund shall be used to provide grant funding to certain
7 political subdivisions for engineering fees arising out of application to the Water
8 Sector Program.

10SUBPART Q-2.  REVITALIZING AND DEVELOPING INFRASTRUCTURE IN ALL
11	OF LOUISIANA FUND
12 §100.123.  Revitalizing and Developing Infrastructure in All of Louisiana Fund
13	A.  There is hereby established in the state treasury as a special fund the
14 Revitalizing and Developing Infrastructure in All of Louisiana Fund, hereafter
15 referred to in this Section as the "RADIAL Fund".  Within the fund are further
16 created the following subfunds: the Construction Subfund and the Preservation
17 Subfund. Monies appropriated or transferred to the RADIAL Fund shall be deposited
18 by the state treasurer after compliance with the provisions of Article VII, Section
19 9(B) of the Constitution of Louisiana.  Of the initial amount deposited into the
20 RADIAL Fund by the Act that originated as House Bill No. 406 of the 2022 Regular
21 Session of the Legislature, an amount equal to four hundred million dollars shall be
22 deposited in and credited to the Construction Subfund, and an amount equal to one
23 hundred million dollars shall be deposited in and credited to the Preservation
24 Subfund.
25	B.  Monies in the RADIAL Fund and subfunds shall be invested by the
26 treasurer in the same manner as state general fund monies.  Interest earned on monies
27 in the RADIAL Fund and subfunds shall be credited to the RADIAL Fund and
28 subfunds for which the interest was earned.  Unexpended and unencumbered monies

1 in the RADIAL Fund and subfunds at the end of the fiscal year shall remain in the
2 RADIAL Fund or subfund to which they are credited.
3	C.  Monies in the Construction Subfund shall be used by the Department of
4 Transportation and Development solely for the direct costs associated with actual
5 project delivery, construction, and maintenance of construction projects approved by
6 the Joint Legislative Committee on the Budget.  Monies in the Preservation Subfund
7 shall be used by the Department of Transportation and Development solely for the
8 direct costs associated with actual project delivery, construction, and maintenance
9 of road repair and preservation projects approved by the Joint Legislative Committee
10 on the Budget.
11 SUBPART Q-3.  MATCHING FUNDS FOR REVOLVING LOAN FUNDS
12 §100.124.  Matching Funds Fund; creation
13	A.  There is hereby created in the state treasury as a special fund the
14 Matching Funds Fund, hereafter referred to in this Section as the "fund".  Monies
15 appropriated or transferred to the fund shall be deposited by the state treasurer after 
16 compliance with the provisions of Article VII, Section 9(B) of the Constitution of
17 Louisiana.  Monies in the fund shall be invested by the treasurer in the same manner
18 as state general fund monies.  Interest earned on monies in the fund shall be credited
19 to the state general fund.  Unexpended and unencumbered monies in the fund at the
20 end of the fiscal year shall remain in the fund.
21	B.  Of the amount originally deposited into the fund by the Act that
22 originated as House Bill No. 406 of the 2022 Regular Session of the Legislature, the
23 Department of Environmental Quality is authorized, subject to appropriation, to use
24 an aggregate amount up to ten million twenty thousand three hundred dollars for
25 matching funds for the Clean Water State Revolving Fund established pursuant to
26 R.S. 30:2302.
27	C.  Of the amount originally deposited into the fund by the Act that
28 originated as House Bill No. 406 of the 2022 Regular Session of the Legislature, the
29 Louisiana Department of Health is authorized, subject to appropriation, to use an

1 aggregate amount up to thirteen million, six hundred seventy-eight thousand seven
2 hundred ninety-eight dollars for matching funds for the Drinking Water Revolving
3 Loan Fund established pursuant to R.S. 40:2823.
4	D. The provisions of this Section shall terminate on December 31, 2026.
5 SUBPART Q-4.  EARLY CHILDHOOD SUPPORTS AND SERVI CES PROGRAM
6	FUND
7 §100.125.  Early Childhood Supports and Services Program Fund; creation
8	A.  There is hereby established in the state treasury as a special fund the Early
9 Childhood Supports and Services Program Fund, hereafter referred to in this Section
10 as the "fund".  Monies appropriated or transferred to the fund shall be deposited by
11 the state treasurer after compliance with the requirements of Article VII, Section
12 9(B) of the Constitution of Louisiana relative to the Bond Security and Redemption
13 Fund.  Monies in the fund shall be invested in the same manner as monies in the state
14 general fund.  Interest earned on investment of monies in the fund shall be credited
15 to the fund.  Until December 1, 2024, unexpended and unencumbered monies in the
16 fund at the end of the fiscal year shall remain in the fund.  The treasurer is hereby
17 authorized and directed to transfer any unexpended and unencumbered monies in the
18 fund on December 1, 2024, and any interest attributable to such funds, to the
19 Louisiana Rescue Plan Fund.  Monies in the fund shall be used by the Louisiana
20 Department of Health to fund its Early Childhood Supports and Service Program.
21	B.  The provisions of this Section shall terminate on December 31, 2026.

23 SUBPART S.  RURAL PRIMARY CARE PHYSICIANS DEVELOPMENT FUND
24 §100.146.  Rural Primary Care Physicians Development Fund; creation
25	A.  There is hereby established in the state treasury as a special fund the
26 Rural Primary Care Physicians Development Fund, hereafter referred to in this
27 Section as the fund.  Monies appropriated or transferred to the fund shall be
28 deposited by the state treasurer after compliance with the requirements of Article
29 VII, Section 9(B) of the Constitution of Louisiana relative to the Bond Security and

1 Redemption Fund.  Monies in the fund shall be invested in the same manner as
2 monies in the state general fund.  Interest earned on investment of monies in the fund
3 shall be credited to the fund.  Until December 1, 2024, unexpended and
4 unencumbered monies in the fund at the end of the fiscal year shall remain in the
5 fund.  The treasurer is hereby authorized and directed to transfer any unexpended and
6 unencumbered monies in the fund on December 1, 2024, and any interest attributable
7 to such funds, to the Louisiana Rescue Plan Fund.  Monies in the fund shall be used
8 by the Louisiana Department of Health to fund the Health Professional Development
9 Program established pursuant to R.S. 40:1205.1 et seq.
10	B.  The provisions of this Section shall terminate on December 31, 2026.

12	SUBPART V.  HURRICANE IDA RECOVERY FUND
13 §100.171.  Hurricane Ida Recovery Fund
14	A.  There is hereby created in the state treasury, as a special fund, the
15 Hurricane Ida Recovery Fund, hereinafter referred to in this Section as the "fund". 
16 Monies in the fund shall be used to assist in repairing structural damage caused by
17 the 2021 hurricane season in South Louisiana.
18	B.  Monies appropriated or transferred to the fund shall be deposited by the
19 state treasurer after compliance with the requirements of Article VII, Section 9(B)
20 of the Constitution of Louisiana relative to the Bond Security and Redemption Fund. 
21 Monies in the fund shall be invested in the same manner as monies in the state
22 general fund.  Interest earned on the investment of monies in the fund shall be
23 deposited in and credited to the fund.  Subject to appropriation, the Department of
24 the Treasury shall administer distribution of monies from the fund.
25	SUBPART W.  CONTINUUM OF CARE FUND
26 §100.181.  Continuum of Care Fund
27	A.  There is hereby established in the state treasury as a special fund the
28 Continuum of Care Fund, hereafter referred to in this Section as the "fund".  Monies
29 appropriated or transferred to the fund shall be deposited by the state treasurer after

1 compliance with the requirements of Article VII, Section 9(B) of the Constitution of
2 Louisiana relative to the Bond Security and Redemption Fund.  Monies in the fund
3 shall be invested in the same manner as monies in the state general fund.  Interest
4 earned on investment of monies in the fund shall be credited to the fund.  Until
5 December 1, 2024, unexpended and unencumbered monies in the fund at the end of
6 the fiscal year shall remain in the fund.  The treasurer is hereby authorized and
7 directed to transfer any unexpended and unencumbered monies in the fund on
8 December 1, 2024, and any interest attributable to such funds, to the Louisiana
9 Rescue Plan Fund.  Monies in the fund shall be used by the Department of Children
10 and Family Services to fund continuum of care initiatives.
11	B.  The provisions of this Section shall terminate on December 31, 2026.
12 Section 5.(A)  This Section and Sections 1, 2, and 4 of this Act shall become
13effective upon signature by the governor or, if not signed by the governor, upon expiration
14of the time for bills to become law without signature by the governor, as provided by Article
15III, Section 18 of the Constitution of Louisiana.  If vetoed by the governor and subsequently
16approved by the legislature, this Section and Sections 1, 2, and 4 of this Act shall become
17effective on the day following such approval.
18 (B)  Section 3 of this Act shall become effective on July 1, 2022; if vetoed by the
19governor and subsequently approved by the legislature, Section 3 of this Act shall become
20effective on July 1, 2022, or on the day following such approval by the legislature,
21whichever is later.

Derelict Crab Trap Removal Account.
Present law (R.S. 39:100.52) establishes the Water Sector Fund and provides for uses of
monies in the fund, including for repairs and improvements necessitated by storm water as
provided in the Water Sector Program.  Proposed law repeals the authority to use Water
Sector Fund monies for repairs and improvements necessitated by storm water.  Further
establishes the Engineering Fee Subfund within the Water Sector Fund for grant funding to
certain political subdivisions for engineering fees arising out of application to the Water
Sector Program.
Proposed law (R.S. 39:100.123) establishes the Revitalizing and Developing Infrastructure
in All of Louisiana Fund ("RADIAL Fund") and provides for deposit and use of monies in
the fund.  Further establishes the Construction Subfund and the Preservation Subfund within
the RADIAL Fund.  Requires monies in the Construction Subfund to be used by the Dept.
of Transportation and Development solely for the direct costs associated with actual project
delivery, construction, and maintenance of construction projects approved by the Joint
Legislative Committee on the Budget.  Requires monies in the Preservation Subfund to be
used by the Dept. of Transportation and Development solely for the direct costs associated
with actual project delivery, construction, and maintenance of road repair and preservation
projects approved by the Joint Legislative Committee on the Budget.
Proposed law (R.S. 39:100.124) establishes the Matching Funds Fund and provides for
deposit and use of monies in the fund.  Authorizes the Dept. of Environmental Quality to use
an aggregate amount up to $10,020,300 of the monies initially deposited into the fund for
matching funds for the Clean Water State Revolving Fund established pursuant in present
law.  Further authorizes the La. Dept. of Health to use an aggregate amount up to
$13,678,798 of the monies initially deposited into the fund for matching funds for the
Drinking Water Revolving Loan Fund established pursuant to present law.
Proposed law (R.S. 39:100.125) establishes Early Childhood Supports and Services Program
Fund and provides for deposit and use of American Rescue Plan Act monies in the fund. 
Authorizes the La. Dept. of Health to use monies in the fund for its Early Childhood
Supports and Service Program.  Provides that until December 1, 2024, unexpended and
unencumbered monies in the fund at the end of the fiscal year remain in the fund.  Further
directs the state treasurer to transfer any unexpended and unencumbered monies in the fund
on December 1, 2024, and any interest attributable to such funds, to the Louisiana Rescue
Plan Fund.  Provides that proposed law terminates on Dec. 31, 2026.

unexpended and unencumbered monies in the fund at the end of the fiscal year remain in the
fund.  Further directs the state treasurer to transfer any unexpended and unencumbered
monies in the fund on Dec. 1, 2024, and any interest attributable to such funds, to the
Louisiana Rescue Plan Fund.  Provides that proposed law terminates on Dec. 31, 2026.

assist in repairing structural damage caused by the 2021 hurricane season in South
Louisiana.
Proposed law (R.S. 39:100.181) establishes the Continuum of Care Fund and provides for
deposit and use of American Rescue Plan Act monies in the fund.  Authorizes the Dept. of
Children and Family Services to use monies in the fund for continuum of care initiatives. 
Provides that until Dec. 1, 2024, unexpended and unencumbered monies in the fund at the
end of the fiscal year remain in the fund.  Further directs the state treasurer to transfer any
unexpended and unencumbered monies in the fund on Dec. 1, 2024, and any interest
attributable to such funds, to the Louisiana Rescue Plan Fund.  Provides that proposed law
terminates on Dec. 31, 2026.
Effective upon signature of governor or lapse of time for gubernatorial action, except that 
transfers in the next fiscal year are effective July 1, 2022.
