HOUSE BILL NO. 421

LEVEES/BDS & DISTRICTS:  Establishes minimum requirements for a levee
commissioner
1	AN ACT
2To amend and reenact R.S. 38:304(A), relative to the requirements for a levee
3 commissioner; to provide relative to the language and education requirement for a
4 levee commissioner; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 38:304(A) is hereby amended and reenacted to read as follows:
7 ยง304.  Appointment of members; residency and education requirements; filling of
8	vacancies
9	A.(1)  Any person appointed a levee commissioner or levee and drainage
10 commissioner must have resided in this state the preceding two years, resided in the
11 levee district the preceding year, be a qualified voter of one of the parishes included
12 in the district, and reside in the district while serving as a member of the board.
13	(2)  Any person appointed a levee commissioner or levee and draining
14 commissioner must be proficient in reading and writing in English and shall possess
15 a high school diploma or its equivalent as determined by the State Board of
16 Elementary and Secondary Education by the date the member is nominated.

Abstract:  Adds a language and education requirement as a prerequisite for appointment as
a levee commissioner or levee and draining commissioner.
Present law requires a levee commissioner or levee and draining commissioner to have
resided in this state the preceding two years, resided in the levee district the preceding year,
be a qualified voter of one of the parishes included in the district, and reside in the district
while serving as a member of the board.
Proposed law maintains present law and requires any person appointed a levee commissioner
or levee and draining commissioner be able to read and write the English language correctly
and possess a high school diploma or its equivalent as determined by the State Bd. of
Elementary and Secondary Education by the date the member is nominated.
