Abstract:  Prohibits the use of DNA obtained from a sexual assault collection kit in an investigation
against the person who submitted the DNA if that person is charged with or suspected of
committing any criminal offense.
Proposed law provides that DNA obtained by a criminal justice agency from a sexual assault
collection kit shall not be compared with other DNA records for the purpose of investigating the
victim of the sexually-oriented criminal offense who submitted the DNA if that victim is charged
with or suspected of committing any criminal offense.

The Committee Amendments Proposed by House Committee on Administration of Criminal
Justice to the original bill:
1. Prohibit the use of DNA obtained by a criminal justice agency from the victim of a
sexually-oriented criminal offense from being used for the purpose of investigating the
victim of the sexually-oriented criminal offense if that victim is charged with or
suspected of committing any criminal offense.
