HLS 22RS-621 ENGROSSED 2022 Regular Session HOUSE BILL NO. 446 BY REPRESENTATIVE DESHOTEL PROPERTY/PUBLIC: Authorizes the Red River, Atchafalaya, and Bayou Beouf Levee District to exchange property in Avoyelles Parish 1 AN ACT 2To authorize and provide for the transfer of certain public property; to authorize the 3 exchange of certain public property in Avoyelles Parish; to provide for the property 4 description; to provide for reservation of mineral rights; to provide terms and 5 conditions; to provide an effective date; and to provide for related matters. 6 Notice of intention to introduce this Act has been published 7 as provided by Article III, Section 13 of the Constitution of 8 Louisiana. 9Be it enacted by the Legislature of Louisiana: 10 Section 1. The board of commissioners of the Red River, Atchafalaya, and Bayou 11Boeuf Levee District, notwithstanding any other provision of law to the contrary, is hereby 12authorized and empowered to convey, transfer, assign, lease, or deliver any interest, 13excluding mineral rights, the district may have in and to all or any portion of the following 14described property to Wade Bordelon: 15 A certain tract or parcel of land, together with all buildings, improvements, right of 16 ways, and privileges thereunto appertaining and being situated in Section 4, 17 T1N-R6E, Avoyelles Parish, Louisiana and being more particularly described wit: 18 19 Proposed Tract 2 20 Point of COMMENCEMENT being a found ½" iron rod on the East bank of 21 R.R.A.B.B. Levee District Borrow Pit at the Northwest corner of Proposed Tract 1; 22 thence along the North boundary line of Proposed Tract 1, N89°29'23"E, a distance 23 of 159.47 feet to a survey point from MML&H Survey; thence along the East 24 boundary line of Proposed Tract 1, S18°20'06"W, a distance of 1538.86 feet to a 25 survey point from MML&H Survey being the POINT OF BEGINNING; thence 26 along the North boundary line of tract herein described, S27°00'36"E, a distance of 27 211.77 feet to a survey point from MML&H Survey; thence along the East boundary Page 1 of 4 HLS 22RS-621 ENGROSSED HB NO. 446 1 line of tract herein described. S29°29'27"W, a distance of 103.83 feet to a survey 2 point; thence along the South boundary line of tract herein described, N69°05'07"W, 3 a distance of 127.30 feet to a survey point; thence along the East boundary line of 4 R.R.A.B.B. Levee District property, N17°32'41"E, a distance of 245.00 feet back the 5 POINT OF BEGINNING and containing 0.57 Acres +/-. Said property being shown 6 as Proposed Tract 2 on Plat Survey by Jared A. Couvillion, Professional Land 7 Surveyor, dated June 6, 2018. 8 Section 2. In exchange for the above described Proposed Tract 2 in Section 1 of this 9Act, the board of commissioners of the Red River, Atchafalaya, and Bayou Boeuf Levee 10District, notwithstanding any other provision of law to the contrary, is hereby authorized and 11empowered to accept, in addition to any other consideration, delivery of title to all or any 12portion of the following described property from Wade Bordelon: 13 A certain tract or parcel of land, together with all buildings, improvements, right of 14 ways, and privileges thereunto appertaining and being situated in Section 4, 15 T1N-R6E, Avoyelles Parish, Louisiana and being more particularly described wit: 16 Proposed Tract 1: 17 Point of BEGINNING being a found ½" iron rod on the East bank of R.R.A.B.B. 18 Levee District Borrow Pit at the Northwest corner of tract herein described; thence 19 along the North boundary line of tract herein described, N89°29'23"E, a distance of 20 159.47 feet to a survey point from MML&H Survey; thence along the East boundary 21 line of tract herein described, S18°20'06"W, a distance of 1538.86 feet to a survey 22 point from MML&H Survey; thence along the East boundary line of R.R.A.B.B. 23 Levee District property the following 2 calls: N17°32'41"E, a distance of 1252.09 24 feet back to the POINT OF BEGINNING and containing 2.30 Acres +/-. Said 25 property being shown as Proposed Tract 1 on Plat of Survey by Jared A. Couvillion, 26 Professional Land Surveyor, dated June 6, 2018. 27 Section 3. The Red River, Atchafalaya, and Bayou Beouf Levee District, is hereby 28authorized to enter into such agreements, covenants, conditions, and stipulations and to 29execute such documents as are necessary to properly effectuate any exchange, conveyance, 30transfer, assignment, lease, or delivery of title, excluding mineral rights, to the property 31described as Proposed Tract 2 in Section 1 of this Act, and as more specifically described 32in any such agreements entered into and documents executed by and between the Red River, 33Atchafalaya, and Bayou Beouf Levee District and Wade Bordelon. 34 Section 4. The board of commissioners of the Red River, Atchafalaya, and Bayou 35Boeuf Levee District, notwithstanding any other provision of law to the contrary, is hereby 36authorized and empowered to convey, transfer, assign, lease, or deliver any interest, 37excluding mineral rights, the district may have in and to all or any portion of the following 38described property to Cutoff Properties, LLC: Page 2 of 4 HLS 22RS-621 ENGROSSED HB NO. 446 1 A certain tract or parcel of land containing approximately 120 acres and being the 2 West Half of the Northwest Quarter (W/2 of NW/4) and the Southeast Quarter of the 3 Northwest Quarter (SE/4 of NW/4) of Section 1, Township 1 South, Range 6 East, 4 Avoyelles Parish. 5 Section 5. In exchange for the above described tract in Section 4 of this Act, the 6board of commissioners of the Red River, Atchafalaya, and Bayou Boeuf Levee District, 7notwithstanding any other provision of law to the contrary, is hereby authorized and 8empowered to accept, in addition to any other consideration, delivery of title to all or any 9portion of the following described property, including all predial servitudes and rights of 10way, from Cutoff Properties, LLC: 11 A 140 acre portion of the following described tract: 12 A certain tract or parcel of land with all timber, buildings and improvements thereon, 13 containing 200 acres, more or less, situated, lying and being in TIS, R6E, 7th Ward 14 of Avoyelles Parish, Louisiana, being the North Half of the Southwest Quarter, and 15 the Southwest Quarter of the Southwest Quarter of Section 29, and the North Half 16 of the Southeast Quarter of Section 30, bounded North by Heartwood Forestland 17 Fund VIII Limited Partnership, South and East by Heartwood Forestland Fund VIII 18 Limited Partnership and Red River, Atchafalaya and Bayou Boeuf Levee District and 19 West by Wayne Joseph Lemoine and Heartwood Forestland Fund VIII Limited 20 Partnership. 21 Section 6. The Red River, Atchafalaya, and Bayou Beouf Levee District, is hereby 22authorized to enter into such agreements, covenants, conditions, and stipulations and to 23execute such documents as are necessary to properly effectuate any exchange, conveyance, 24transfer, assignment, lease, or delivery of title, excluding mineral rights, to the property 25described in Section 4 of this Act, and as more specifically described in any such agreements 26entered into and documents executed by and between the Red River, Atchafalaya, and 27Bayou Beouf Levee District and Cutoff Properties, LLC. 28 Section 7. This Act shall become effective upon signature by the governor or, if not 29signed by the governor, upon expiration of the time for bills to become law without signature 30by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 31vetoed by the governor and subsequently approved by the legislature, this Act shall become 32effective on the day following such approval.
