HOUSE BILL NO. 507

VITAL RECORDS/BIRTH CERT:  Provides relative to surnames recorded on original birth
certificates
1	AN ACT
2To enact R.S. 40:34.2(2)(a)(v), relative to birth certificates; to provide for an official
3 surname for birth certificates; and to provide for related matters.
4Be it enacted by the Legislature of Louisiana:
5 Section 1.  R.S. 40:34.2(2)(a)(v) is hereby enacted to read as follows: 
6 ยง34.2.  Original birth certificate; required contents; name of child
7	The name of the child shall be entered on the original birth certificate in
8 accordance with the following provisions:

10	(2)  Surname.
11	(a)  Unless otherwise provided by law and except as provided in
12 Subparagraph (c) of this Paragraph, if the child is born to a mother who either is
13 married or was married within three hundred days prior to the birth of the child, the
14 surname of the child shall be recorded in accordance with the following
15 requirements:

17	(v)  For the purposes of this Section, in any case in which a child is born to
18 a parent or parents who possess both paternal and maternal surnames because of

1 national law or custom, the paternal surname of the child's father shall be the official 
2 surname of the child on the original birth certificate.

Abstract:  Requires the paternal surname of the child's father to be the official surname of
the child on the original birth certificate.
Proposed law requires the paternal surname of the child's father to be the official surname
of any child born to a parent or parents who possess both paternal and maternal surnames
because of national law or custom.
