MTR VEHICLE/INSPECTION: Provides relative to a commercial motor vehicle inspection

2To amend and reenact R.S. 32:1306(C)(1)(c) and 1311(E)(2) and (3) and to repeal R.S.
3 32:1306(C)(5), relative to an annual commercial motor vehicle inspection; to repeal
4 provisions relative to the annual fee or charge along with the percentage retained by
5 the inspector and the percentage transferred to certain offices for a commercial motor
6 vehicle inspection; to exempt commercial vehicles from the required one-year or
7 two-year certificates of inspection; and to provide for related matters.
8Be it enacted by the Legislature of Louisiana:
9 Section 1. R.S. 32:1306(C)(1)(c) and 1311(E)(2) and (3) are hereby amended and
10reenacted to read as follows:

2 including Part 396.17 and "Appendix G" thereof.

8 (2) As an alternate means of compliance with the requirements of 49 CFR,
9 the owner or operator of a commercial motor vehicle truck tractor may opt to obtain
10 a Louisiana commercial motor vehicle inspection certificate which satisfies the
11 requirements of 49 CFR 396.17. A trailer or semitrailer being used in combination
12 with a truck tractor meeting such exemption may opt to obtain a Louisiana
13 commercial motor vehicle inspection certificate which satisfies the requirements of
14 49 CFR 396.17.
15 (3) As used in this Subsection, "commercial motor vehicle" means any self-
16 propelled truck tractor or towed vehicle which is used on public highways to
17 transport property in interstate commerce, has been issued an apportioned plate
18 through the International Registration Plan; and

Abstract: Exempts commercial vehicles from the required one-or two-year certificates of
inspection and repeals provisions relative to the annual fee or charge for a
commercial motor vehicle inspection.
Present law requires a charge or fee be charged for each certificate of inspection and
approval issued as provided in present law.
Present law provides an exemption from the provisions of present law for student
transportation vehicles.

Proposed law modifies present law to include an exemption for commercial motor vehicles.
Present law requires an annual charge of $30 for the inspection of all commercial motor
vehicles which are required to be inspected under the provisions of federal law. Provides
no charge or fee other than the $30 fee will be charged for a commercial motor vehicle
inspection.

Present law requires the motor vehicle inspection station operator who performs the
inspection retain $23.75, $2.25 to be transferred to the office of motor vehicles for expenses
associated with motor vehicle and financial responsibility programs, and $4 to be transferred
to the office of state police for use in traffic law enforcement.
Present law requires the adjustment of headlights at no additional cost to the operator of the
motor vehicle being inspected be included in the inspection. Specifies that the Legislature
of Louisiana declares that a commercial motor vehicle inspection is much more extensive
than the inspection mandated in present law and that the increase in fee or charge for the
inspection of commercial vehicles is based on the difference in the two types of inspection.
Present law authorizes the owner or operator of a commercial motor vehicle truck tractor to
obtain a La. commercial motor vehicle inspection certificate to satisfy the requirements of
present law (49 CFR 396.17) as an alternate means of compliance with the requirements of
present law (49 CFR). Authorizes a trailer or semitrailer being used in combination with a
truck tractor meeting the exemption to obtain a La. commercial motor vehicle inspection
certificate to satisfy the requirements of present law.
Proposed law removes present law.
(Amends R.S. 32:1306(C)(1)(c) and 1311(E)(2) and (3); Repeals R.S. 32:1306(C)(5))
