R.S. 40:1250.31(A)(1) is hereby amended and reenacted to read as 10follows: 11 ยง1250.31. Dental care for certain adults with developmental or intellectual 12 disabilities; Medicaid coverage required 13 A.(1) The Louisiana Department of Health shall ensure that comprehensive 14 Medicaid coverage for dental care is provided to all of the following persons: 15 (a) Each each person of age twenty-one or older who is enrolled in any 16 Medicaid waiver program for persons with developmental or intellectual disabilities. 17 (b) Each Medicaid enrollee of age twenty-one or older who resides in an 18 intermediate care facility for people with developmental disabilities licensed in 19 accordance with the provisions of R.S. 40:2180 et seq. 20 * * * Page 1 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. The provisions of Section 1 of this Act shall become effective when an 2Act of the Louisiana Legislature containing a specific appropriation of monies for the 3implementation of the provisions of this Act becomes effective. 4 Section 3. The provisions of Sections 2 and 3 of this Act shall become effective 5upon signature by the governor or, if not signed by the governor, upon expiration of the time 6for bills to become law without signature by the governor, as provided by Article III, Section 718 of the Constitution of Louisiana. If vetoed by the governor and subsequently approved 8by the legislature, Sections 2 and 3 of this Act shall become effective on the day following 9such approval. [R.S. 1:13(B) and 24:177(E)] HB 55 Reengrossed 2022 Regular Session Butler Abstract: Extends Medicaid coverage for dental care to Medicaid enrollees age 21 and up who reside in intermediate care facilities for people with developmental disabilities. Present law requires the La. Department of Health (LDH) to ensure that comprehensive Medicaid coverage for dental care is provided to each person of age 21 or older who is enrolled in any Medicaid waiver program for persons with developmental or intellectual disabilities. Proposed law retains present law and extends the Medicaid dental coverage provided for therein to each Medicaid enrollee of age 21 or older who resides in a state-licensed intermediate care facility for people with developmental disabilities. Proposed law retains present law stipulating that LDH shall not furnish any Medicaid dental coverage required by present law or proposed law until all of the following have occurred: (1)The Centers for Medicare and Medicaid Services have approved the provision of such coverage. (2)The legislature has appropriated the funding necessary for the provision of such coverage. Effective when an Act of the Louisiana Legislature containing a specific appropriation of monies for the implementation of the provisions of proposed law becomes effective.
