HOUSE BILL NO. 557

INSURANCE/HEALTH:  Provides relative to the dispensing of contraceptives
1	AN ACT
2To enact R.S. 22:1033.1 and Subpart E of Part I of Chapter 5-E of Title 40 of the Louisiana
3 Revised Statutes of 1950, to be comprised of R.S. 40:1248.21, relative to the
4 dispensation of contraceptives; to require a health coverage plan to provide
5 reimbursement for a twelve-month supply of contraceptive drugs dispensed at one
6 time; to provide for the Louisiana Department of Health relative to requiring health
7 plans of the state Medicaid program to provide reimbursement for a twelve-month
8 supply of contraceptive drugs dispensed at one time; to provide for a required usage
9 period; to provide for definitions; and to provide for related matters.
10Be it enacted by the Legislature of Louisiana:
11 Section 1.  R.S. 22:1033.1 is hereby enacted to read as follows:
12 §1033.1.  Dispensation of contraceptive drugs; twelve-month supply; coverage
13	A.  A health coverage plan including a group coverage plan issued or
14 renewed in this state on or after January 1, 2023, providing coverage for
15 contraceptive drugs shall provide reimbursement for a twelve-month supply to be
16 obtained at one time by the insured, unless the insured requests a smaller supply or
17 the prescribing provider instructs for the insured to receive a smaller supply.  The
18 insured shall have used the same contraceptive drugs for at least the consecutive
19 twelve months prior to receiving a twelve-month supply.  The health coverage plan
20 or group coverage plan shall allow the insured to receive the contraceptive drugs

1 onsite at the provider's office, if available.  Dispensing practices required by the plan
2 shall follow all clinical guidelines for appropriate prescribing and dispensing to
3 ensure the health of the insured while maximizing access to effective contraceptive
4 drugs.
5	B.  For purposes of this Section, "contraceptive drugs" means all drugs
6 approved by the United States Food and Drug Administration that are used to
7 prevent pregnancy including but not limited to hormonal drugs administered orally,
8 transdermally, and intravaginally.
9 Section 2. Subpart E of Part I of Chapter 5-E of Title 40 of the Louisiana Revised
10Statutes of 1950, comprised of R.S. 40:1248.21, is hereby enacted to read as follows:
11 SUBPART E. MEDICAID COVERAGE FOR CONTRACEPTIVES
12 §1248.21.  Dispensation of contraceptive drugs; twelve-month supply; coverage
13	A.  The Louisiana Department of Health shall require all Medicaid health
14 plans issued or renewed in this state on or after January 1, 2023, to include the
15 dispensing of contraceptive drugs with a twelve-month supply to be obtained at one
16 time by the insured, unless the insured requests a smaller supply or the prescribing
17 provider instructs for the insured to receive a smaller supply.  The insured shall have
18 used the same contraceptive drugs for at least the consecutive twelve months prior
19 to receiving a twelve-month supply.  Contracts with managed care plans shall allow
20 the insured to receive onsite dispensing of the prescribed contraceptive drugs at
21 family practice clinics, if available.  Dispensing practices shall follow all clinical
22 guidelines for appropriate prescribing and dispensing to ensure the health of the
23 insured while maximizing access to effective contraceptive drugs.
24	B.  For purposes of this Section, "contraceptive drugs" means all drugs
25 approved by the United States Food and Drug Administration that are used to
26 prevent pregnancy including but not limited to hormonal drugs administered orally,
27 transdermally, and intravaginally.

Proposed law generally requires a health coverage plan including a group coverage plan and
Medicaid health plans issued or renewed in this state on or after January 1, 2023, providing
coverage for contraceptive drugs to reimburse for a 12-month supply of contraceptive drugs
to be obtained at one time by the insured, unless the insured requests a smaller supply or the
prescribing provider instructs for the insured to receive a smaller supply.  Further requires
the insured to have used the same contraceptive drugs for at least the consecutive 12 months
prior to receiving a 12-month supply.
Proposed law requires a health coverage plan or group coverage plan and Medicaid health
plans to allow the insured to receive the contraceptive drugs onsite at the provider's office.
Requires dispensing practices to follow all clinical guidelines for appropriate prescribing and
dispensing to ensure the health of the insured while maximizing access to effective
contraceptive drugs.
Proposed law defines "contraceptive drugs".
