HOUSE BILL NO. 587
BY REPRESENTATIVES HILFERTY AND WILLARD
LEVEES/BDS & DISTRICTS:  Modifies the composition of the Lakefront Management
Authority
1	AN ACT
2To amend and reenact R.S. 38:330.12.1(C)(5) and (7), relative to the composition of the
3 Lakefront Management Authority Board; to provide relative to the appointment of
4 authority members; and to provide for related matters.
5	Notice of intention to introduce this Act has been published
6	as provided by Article III, Section 13 of the Constitution of
7	Louisiana.
8Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 38:330.12.1(C)(5) and (7) are hereby amended and reenacted to read
10as follows:
11 ยง330.12.1.  Lakefront Management Authority; creation; composition; powers, duties,
12	functions

14	C.  The authority shall be composed of the following members who shall be
15 subject to Senate confirmation, provided that no elected official shall be appointed
16 to serve as a member of the authority:

18	(5)  Two members appointed jointly by the presidents of the Lakeshore, Lake
19 Vista, Lake Terrace, and Lake Oaks property owners associations.  The associations
20 involved in the appointment of these members shall comply with the following:

1	(a)  The appointed members shall reside within the residential boundaries of
2 the Lakeshore, Lake Vista, Lake Terrace, and Lake Oaks neighborhoods. 
3	(b)  Preference shall be given to the neighborhood with the least number of
4 representatives appointed for the authority.
5	(c)  Nomination and reappointment shall be determined by a majority vote
6 of the presidents of the property owners associations.

8	(7)  One member appointed by the Lake Pontchartrain Basin Foundation
9 Pontchartrain Conservancy.

Abstract: Provides relative to appointments to the Lakefront Management Authority.
Present law establishes the Lakefront Management Authority.
Present law requires the authority be composed of the following members subject to Senate
confirmation, provided no elected official be appointed to serve as a member of the
authority:
(1)One member appointed by the Southeast La. Flood Protection Authority East.
(2)One member appointed by the state senator representing Senate District No. 3 and
Senate District No. 4, and by the state representative representing House District No.
97, House District No. 94, House District No. 99, and two members appointed by the
Congressional Representative representing Congressional District No. 2.  At least
one member appointed is required to be a lawyer, at least one member is required to
be a certified public accountant, and at least one member is required to be a realtor.
(3)One member appointed by the mayor of the city of New Orleans.
(4)One member appointed by each New Orleans city council member in whose district
a non-flood asset is located.
(5)Two members appointed jointly by the presidents of the Lakeshore, Lake Vista, Lake
Terrace, and Lake Oaks property owners associations.
(6)One member appointed by the secretary of the Dept. of Transportation and
Development.
(7)One member appointed by the Lake Pontchartrain Basin Foundation.
(8)One member appointed by the board for the New Orleans City Park.

Proposed law requires the appointments by the presidents of the Lakeshore, Lake Vista,
Lake Terrace, and Lake Oaks property owners associations reside within the residential
boundaries of the Lakeshore, Lake Vista, Lake Terrace, and Lake Oaks neighborhoods.
Proposed law requires preference be given to the neighborhood with the least number of
representatives appointed for the authority.  Also requires nomination and reappointment of
the appointees be determined by a majority vote of the presidents of the property owners
associations.
Proposed law changes the name of an appointing authority in present law from the Lake
Pontchartrain Basin Foundation to the Pontchartrain Conservancy.

Summary of Amendments Adopted by House
The House Floor Amendments to the engrossed bill:
1. Makes technical changes.
2. Delete the provision that identified the number of members of the authority.
3. Revert back to present law by changing the number of appointments from the
presidents of the Lakeshore, Lake Vista, Lake Terrace, and Lake Oaks property
owners associations from four members selected by each of the property owners
associations to two members selected jointly by the presidents of the property
owners associations.
4. Require the appointments by Lakeshore, Lake Vista, Lake Terrace, and Lake
Oaks property owners associations reside within the residential boundaries of the
Lakeshore, Lake Vista, Lake Terrace, and Lake Oaks neighborhoods.
5. Require preference be given to the neighborhood with the least number of
representatives appointed for the authority.
6. Require nomination and reappointment of the appointees by the presidents of the
property owners associations be determined by a majority vote.
7. Change the name of an appointing authority from Lake Pontchartrain Basin
Foundation to the Pontchartrain Conservancy.
