CRIME:  Provides relative to penalties for the crime of simple cruelty to animals
1	AN ACT
2To amend and reenact R.S. 14:102.1(A)(2)(a), relative to cruelty to animals; to provide
3 relative to the penalties for a first offense of the crime of cruelty to animals; to
4 provide relative to payments for expenses incurred for the animal; and to provide for
5 related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 14:102.1(A)(2)(a) is hereby amended and reenacted to read as
8follows: 
9 ยง102.1.  Cruelty to animals; simple and aggravated
10	A.

12	(2)(a)  Whoever commits the crime of simple cruelty to animals shall be fined
13 not more than one thousand dollars, or imprisoned for not more than six months, or
14 both.  In addition, the court may order the offender to pay for any expenses incurred
15 for the housing of the animal and for medical treatment of the animal, pursuant to
16 Code of Criminal Procedure Article 883.2.

Abstract:  Provides relative to the payment of expenses incurred for a first offense of simple
cruelty to animals.
Present law provides for the crime of simple cruelty to animals and provides that whoever
commits a first offense of simple cruelty to animals shall be fined not more than $1,000, or
imprisoned for not more than six months, or both.
Proposed law retains present law and provides that the court may order the offender to pay
for any expenses incurred for the housing of the animal and for medical treatment of the
animal, pursuant to present law (C.Cr.P. Art. 883.2).

Summary of Amendments Adopted by House
The Committee Amendments Proposed by House Committee on Administration of
Criminal Justice to the original bill:
1. Remove the proposed law minimum fine and minimum term of imprisonment.
2. Provide that the court may order the offender to pay for the housing of the
animal, along with any medical treatment of the animal.
3. Provide that any payments ordered by the court for expenses incurred are to be
made pursuant to present law (C.Cr.P. Art. 883.2).
