R.S. 40:2869(D) and (E) are hereby amended and reenacted and R.S. 840:2869(A)(21) through (25) are hereby enacted to read as follows: 9 ยง2869. Pharmacy benefit manager monitoring advisory council; membership; 10 functions 11 A. The advisory council shall provide monitoring of pharmacy benefit 2 managers in Louisiana to advise the legislature, commissioner of insurance, and 3 Board of Pharmacy on the most effective and efficient manner of regulation of 4 pharmacy benefit managers to ensure the protection of the public. Any licensed 5 pharmacy benefit manager operating in the state of Louisiana shall provide full 6 cooperation with the advisory council on matters including but not limited to those 7 set forth in Subsection E of this Section. 8 E. The advisory council shall advise on matters that include but are including 9 but not limited to the licensure and regulation of pharmacy benefit managers set forth 10 in Title 22, Title 37, and Title 40 of the Louisiana Revised Statutes of 1950, 11 applicable rules and regulations of state agencies, and federal laws or rules relative 12 to pharmacy benefit managers. 13 Section 2. This Act shall become effective upon signature by the governor or, if not 14signed by the governor, upon expiration of the time for bills to become law without signature 15by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 16vetoed by the governor and subsequently approved by the legislature, this Act shall become 17effective on the day following such approval.
