HLS 22RS-922 ORIGINAL 2022 Regular Session HOUSE BILL NO. 708 BY REPRESENTATIVE MCFARLAND ENERGY: Defines biomass as it relates to the Louisiana Renewable Energy Development Act 1 AN ACT 2To enact R.S. 51:3061(3) and 3062(6), relative to the Louisiana Renewable Energy 3 Development Act; to provide for legislative findings; to define the term "biomass"; 4 and to provide for related matters. 5Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 51:3061(3) and 3062(6) are hereby enacted to read as follows: 7 §3061. Legislative findings 8 The legislature hereby finds and declares that: 9 * * * 10 (3) Energy produced from forest products manufacturing bioenergy 11 feedstocks shall be considered renewable and carbon neutral. 12 §3062. Definitions 13 As used in this Chapter, the following words and phrases shall have the 14 meaning ascribed to them in this Section, unless the context clearly indicates 15 otherwise: 16 * * * 17 (6) "Biomass" means forest products manufacturing bioenergy feedstocks, 18 which may include but not be limited to the following: 19 (a) Forest products manufacturing residuals, including but not limited to 20 spent pulping liquors, pulping by-products, woody manufacturing residuals, paper Page 1 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HLS 22RS-922 ORIGINAL HB NO. 708 1 recycling residuals, wastewater and process water treatment plant residuals, and 2 anaerobic digester biogas. 3 (b) Harvest residues, including trees or portions of harvested trees that are 4 too small or of too poor quality to be utilized for wood products or paper products. 5 (c) Downed wood from extreme weather events and natural disasters, 6 nonhazardous landscape or right-of-way trimmings and municipal trimmings, and 7 plant material removed for purposes of invasive or noxious plant species control; 8 biowaste, including landfill gas. 9 (d) Forest biomass derived from residues created as a by-product of timber 10 harvesting, including but not limited to low-value wood, treetops, and tree limbs. 11 (e) Forest management activities conducted for stand improvement or to 12 increase yield, ecological restoration, or to maintain or enhance forest health 13 including but not limited to hazardous fuels reduction. 14 (f) Biomass materials recognized by the United State Environmental 15 Protection Agency as fuels under 40 CFR Part 241.4. 16 (g) Other used wood products, such as crates or pallets. 17 Section 2. The Louisiana Law Institute is directed to alphabetize and renumber the 18terms defined in R.S. 51:3062, as amended by the provisions of this Act.
