HOUSE BILL NO. 72

DISTRICTS/FIRE PROTECT:  Provides relative to the board of commissioners of
Terrebonne Parish Fire Protection District Number Six
1	AN ACT
2To amend and reenact R.S. 40:1496(F), relative to Terrebonne Parish Fire Protection District
3 Number Six; to provide for membership of its board of commissioners; to provide
4 for an effective date; and to provide for related matters.
5	Notice of intention to introduce this Act has been published
6	as provided by Article III, Section 13 of the Constitution of
7	Louisiana.
8Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 40:1496(F) is hereby amended and reenacted to read as follows:
10 ยง1496.  Appointment of members of board; term; vacancies

12	F.  Notwithstanding any provision of this Section to the contrary, the board
13 of commissioners of Terrebonne Parish Fire Protection District Number Six shall
14 consist of seven five members to be appointed as follows provided that the governing
15 authority of Terrebonne Parish and the governing authority of Lafourche Parish have
16 respectively authorized the extension of the boundaries of Terrebonne Parish Fire
17 Protection District Number Six into Lafourche Parish as such an extension is
18 provided for by R.S. 40:1493 and 1494:

1	(1)  Five Four members shall be appointed by the governing authority of
2 Terrebonne Parish.  Such commissioners shall be electors of the area of Terrebonne
3 Parish lying within the boundaries of the district.
4	(2)  Two commissioners One commissioner shall be appointed by the
5 governing authority of Lafourche Parish.  Such commissioners commissioner shall
6 be electors an elector of the area of Lafourche Parish lying within the boundaries of
7 the district.
8	(3)  The commissioners so appointed shall elect from their number a
9 chairman of the board.
10	(4)  Initial terms of two of the commissioners from Terrebonne Parish and
11 one of the commissioners commissioner from appointed by the governing authority
12 of Lafourche Parish shall be one year, and the initial terms of the remaining
13 commissioners shall be two years as determined by lot.  All subsequent terms The
14 term of office for each commissioners commissioner shall be two years.

16 Section 2.  This Act does not require the removal of any member of the board serving
17on the effective date of this Act.
18 Section 3.  This Act shall become effective upon signature by the governor or, if not
19signed by the governor, upon expiration of the time for bills to become law without signature
20by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
21vetoed by the governor and subsequently approved by the legislature, this Act shall become
22effective on the day following such approval.

Abstract:  Provides for changes to the board of commissioners of Terrebonne Parish Fire
Protection District Number Six.
Present law provides for the appointment of members to the board of commissioners of fire
protection districts.  Generally provides that the board of commissioners shall consist of five
members; provides exceptions.
Present law provides that the board of commissioners of Terrebonne Parish Fire Protection
District No. Six shall consist of seven members if the Terrebonne Parish and Lafourche
Parish governing authorities authorize extending the district into Lafourche Parish.
Present law provides that five members from the portion of the district in Terrebonne Parish
and two from the portion of the district in Lafourche Parish shall be appointed by the
respective parish governing authorities.  Requires that the members be electors of the portion
of the district within their respective parish.  Provides for the commissioners to elect the
chairman.
Proposed law provides for the following changes:
(1)Changes total number of board members from seven to five.
(2)Changes number of commissioners appointed by the governing authority of
Terrebonne Parish from five to four.
(3)Changes number of commissioners appointed by the governing authority of
Lafourche Parish from two to one.
(4)Removes requirement that a member appointed by Lafourche Parish be an elector of
that parish.
Otherwise retains present law.
Effective upon signature of the governor or lapse of time for gubernatorial action.
