DRUGS:  Provides relative to the definition of drug paraphernalia
1	AN ACT
2To enact R.S. 40:1021(B), relative to drug related objects; to provide relative to the
3 definition of drug paraphernalia; to exclude equipment or devices used for the
4 inhalation of raw or crude marijuana for therapeutic use; and to provide for related
5 matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 40:1021(B) is hereby enacted to read as follows: 
8 ยง1021.  Definitions

10	B.  Notwithstanding any other provision of law to the contrary, the term
11 "drug paraphernalia" shall not include any equipment or devices solely used or
12 intended for use for the inhalation of raw or crude marijuana, tetrahydrocannabinols,
13 or a chemical derivative of tetrahydrocannabinols when the person is a patient of a
14 state-sponsored medical marijuana program and possesses medical marijuana in a
15 form permissible under R.S. 40:1046 for therapeutic use.

Abstract:  Excludes from the definition of drug paraphernalia equipment or devices used
or intended for use for the inhalation of raw or crude marijuana for therapeutic use
for persons who are patients of a state-sponsored medical marijuana program.
Present law defines "drug paraphernalia".
Proposed law excludes any equipment or devices solely used or intended for use for the
inhalation of raw or crude marijuana, tetrahydrocannabinols, or a chemical derivative of
tetrahydrocannabinols when a person is a patient of a state-sponsored medical marijuana
program and possesses medical marijuana in a form permissible under present law (R.S.
40:1046) for therapeutic use.

Summary of Amendments Adopted by House
The House Floor Amendments to the engrossed bill:
1. Provide that proposed law applies to persons who are patients of a state-
sponsored medical marijuana program and possess marijuana in a form
permissible under present law for therapeutic use.
