[R.S. 1:13(B) and 24:177(E)] HB 775 Reengrossed 2022 Regular Session Glover Abstract: Excludes from the definition of drug paraphernalia equipment or devices used or intended for use for the inhalation of raw or crude marijuana for therapeutic use for persons who are patients of a state-sponsored medical marijuana program. Present law defines "drug paraphernalia". Proposed law excludes any equipment or devices solely used or intended for use for the inhalation of raw or crude marijuana, tetrahydrocannabinols, or a chemical derivative of tetrahydrocannabinols when a person is a patient of a state-sponsored medical marijuana program and possesses medical marijuana in a form permissible under present law (R.S. 40:1046) for therapeutic use. (Adds R.S. 40:1021(B)) Summary of Amendments Adopted by House The House Floor Amendments to the engrossed bill: 1. Provide that proposed law applies to persons who are patients of a state-sponsored medical marijuana program and possess marijuana in a form permissible under present law for therapeutic use.
