HLS 22RS-1059 ORIGINAL 2022 Regular Session HOUSE BILL NO. 799 BY REPRESENTATIVES WRIGHT AND SCHEXNAYDER MANUFACTURING: Allows for exemption from certain regulatory measures placed on manufacturers of certain food and drug products 1 AN ACT 2To amend and reenact R.S. 40:627(A) and to enact R.S. 40:627(F), relative to the production 3 and sale of certain food and drug products; to require good cause; to provide an 4 application for exemption; to provide for rulemaking; and to provide for related 5 matters. 6Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 40:627(A) is hereby amended and reenacted and R.S. 40:627(F) is 8hereby enacted to read as follows: 9 ยง627. Registration of certain products 10 A. Except as provided in Subsection E Subsections E and F of this Section, 11 the department may, for good cause, require all manufacturers, packers, or 12 proprietors of processed foods, proprietary or patent medicines, prophylactic devices, 13 and cosmetics, in package form, to register each separate and distinct product 14 annually with the department and to supply it with a sample of each such product 15 upon request. 16 * * * 17 F.(1) Any manufacturer, packer, or proprietor who may be required to 18 register or supply a product pursuant to this Section, may submit an application to 19 the department, requesting exemption from these provisions based upon lack of good Page 1 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. In assessing good cause, the department shall consider the burden on the 2 manufacturer, packer, or proprietor as well as the benefit to public health and safety. 3 (2) The department shall provide a written decision to the applicant within 4 thirty days of submission of the application. 5 (3) The department shall promulgate rules to implement the provisions of 6 this Subsection. Dept of Health (department) to find good cause when enforcing certain regulations on a manufacturer, packer, or proprietor of certain products. Present law allows the department to require a manufacturer, packer, or proprietor of certain products to register each separate and distinct product annually with the department and to supply it with a sample of each such product upon request. Proposed law retains present law in part, but requires the department to find good cause in order to mandate compliance with present law. Proposed law allows a person subject to proposed law to apply to the department for exemption.
