WEAPONS/FIREARMS: Provides an exception to the illegal carrying of weapons for city
prosecutors and assistant city prosecutors
1 AN ACT
2To amend and reenact R.S. 14:95(H)(1), relative to carrying of weapons; to provide relative
3 to the crime of illegal carrying of weapons; to provide for exceptions; and to provide
4 for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 14:95(H)(1) is hereby amended and reenacted to read as follows:
7 ยง95. Illegal carrying of weapons

9 H.(1) Except as provided in Paragraph (A)(5) of this Section and in
10 Paragraph (2) of this Subsection, the provisions of this Section shall not prohibit
11 active justices or judges of the supreme court, courts of appeal, district courts, parish
12 courts, juvenile courts, family courts, city courts, federal courts domiciled in the state
13 of Louisiana, and traffic courts, members of either house of the legislature, officers
14 of either house of the legislature, the legislative auditor, designated investigative
15 auditors, constables, coroners, designated coroner investigators, district attorneys and
16 designated assistant district attorneys, United States attorneys and assistant United
17 States attorneys and investigators, the attorney general, designated assistant attorneys
18 general, city prosecutors, assistant city prosecutors, and justices of the peace from
19 possessing and concealing a handgun on their person when such persons are

1 qualified annually in the use of firearms by the Council on Peace Officer Standards
2 and Training.

Abstract: Provides an exception to the illegal carrying of weapons for city prosecutors and
assistant city prosecutors.
Present law provides that present law shall not prohibit certain active persons from
possessing and concealing a handgun on their person when such persons are qualified
annually in the use of firearms by the Council on Peace Officer Standards and Training.
Proposed law retains present law and adds city prosecutors and assistant city prosecutors to
the list of certain active persons who are not prohibited from possessing and concealing a
handgun when the person is qualified annually by the Council on Peace Officer Standards
and Training.
