HOUSE CONCURRENT RESOL UTION NO. 101
BY REPRESENTATIVE BACALA
COURTS/CRIMINAL:  Requests a study relative to reporting requirements for active felony
cases in each judicial district
1	A CONCURRENT RESOL UTION
2To urge and request the Judicial Council of the Supreme Court of Louisiana to conduct a
3 comprehensive study of active felony cases in each district court within every
4 judicial district of the state of Louisiana and to report its initial findings to the
5 Legislature of Louisiana prior to the 2023 Regular Session of the Legislature and
6 annually thereafter no later than March 1st of each year.
7 WHEREAS, Louisiana Supreme Court Rule XXII, Section 5(a) provides that a
8function of the Judicial Council is to continuously study the organization of the courts, the
9rules, procedures, and practices of the judicial system of the state, as well as of the work
10accomplished and the results attained by the Judicial Council, and of the uniformity of the
11exercise of discretionary power of the courts, to the end that procedure may be simplified,
12business expedited, and justice better administered; and
13 WHEREAS, as national prosecution standards shift, it would be prudent to examine 
14the caseload data from each district court in the state of Louisiana to determine if judicial
15resources are being used in the most efficient manner possible; and
16 WHEREAS, thousands of criminal cases have been delayed due to the COVID-19
17pandemic; and
18 WHEREAS, a criminal case has many stages that include but are not limited to
19arrest, arraignment, evidentiary hearings, trial, appeals, and sentencing, therefore obtaining
20and studying the caseload and other data may be beneficial to determine the adequacy and
21efficiency of the judicial system.

1 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby
2urge the Judicial Council to conduct an initial comprehensive study of active felony cases
3in each district court within every judicial district of the state of Louisiana and to report its
4initial findings to the Legislature of Louisiana prior to the 2023 Regular Session of the
5Legislature and annually thereafter no later than March 1st of each year.
6 BE IT FURTHER RESOLVED that each annual report shall include the following
7information:
8 (1)  The number of active felony criminal cases in each division.
9 (2)  For all felony criminal cases filed since January 1, 2020, the percent of cases
10adjudicated within each of the following time periods:
11 (a)  Six months from the date of arraignment.
12 (b)  One year from the date of arraignment.
13 (c)  Two years from the date of arraignment.
14 (d)  Three or more years from the date of arraignment.
15 BE IT FURTHER RESOLVED that should the Judicial Council determine that such
16information is not available then the Judicial Council shall notify the Legislature of
17Louisiana, and make recommendations regarding changes necessary to implement the
18purpose of this resolution prior to the 2023 Regular Session of the Legislature.
19 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the
20judicial administrator of the Supreme Court of Louisiana for distribution to members of the
21Judicial Council. 
22 BE IT FURTHER RESOLVED that one print copy and one electronic copy of any
23report produced pursuant to this Resolution shall be submitted to the David R. Poynter
24Legislative Research Library as required by R.S. 24:772.
