HOUSE CONCURRENT RESOL UTION NO. 51
BY REPRESENTATIVE GREGORY MILLER
LEGISLATIVE AGCY/LAW INST:  Directs the La. State Law Institute to stop printing
unconstitutionally adopted language in Article I, Section 10 of the La. Constitution
1	A CONCURRENT RESOL UTION
2To authorize and direct the Louisiana State Law Institute to direct the printer of the
3 Constitution of Louisiana to stop printing unconstitutionally adopted language in
4 Article I, Section 10 of the Constitution of Louisiana.
5 WHEREAS, the Legislature of Louisiana enacted Act No. 1492 of the 1997 Regular
6Session of the Legislature of Louisiana which proposed to amend Article I, Section 10 of the
7Constitution of Louisiana; and
8 WHEREAS, the enrolled bill which was submitted to the voters did not incorporate
9an amendment adopted by the House and concurred in by the Senate; and
10 WHEREAS, at the congressional primary election held in 1998, a majority of the
11electors of the state voted in favor of Act No. 1492; and
12 WHEREAS, the Louisiana Supreme Court held in Shepherd v. Schedler, 209 So.3d
13752 (La. 1/27/16), that Act No. 1492 of the 1997 Regular Session of the Legislature of
14Louisiana is null and void because it was not constitutionally adopted; and
15 WHEREAS, the printer of the Constitution of Louisiana continues to print Article
16I, Section 10 of the Constitution of Louisiana as amended by Act. No. 1492 accompanied
17by a validity note regarding the holding of the supreme court.
18 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby
19authorize and direct the Louisiana State Law Institute to direct the printer of the Constitution
20of Louisiana to stop printing the unconstitutionally adopted language and to direct the
21printing of Article I, Section 10 of the Constitution of Louisiana as follows:

1 "ยง10.  Right to Vote
2	Section 10.  Right to Vote.  Every citizen of the state, upon reaching eighteen
3 years of age, shall have the right to register and vote, except that this right may be
4 suspended while a person is interdicted and judicially declared mentally incompetent
5 or is under an order of imprisonment for conviction of a felony."
6 BE IT FURTHER RESOLVED that two copies of this Resolution be transmitted to
7the Louisiana State Law Institute and that the Louisiana State Law Institute forward one such
8copy to the printer of the Constitution of Louisiana.
