HLS 22RS-5452 ORIGINAL 2022 Regular Session HOUSE RESOLUTION NO. 268 BY REPRESENTATIVE ZERINGUE MTR VEHICLE/COMMERCIAL: Urges and requests various state agencies to study the process and fees associated with commercial motor vehicle inspections required under federal provisions 1 A RESOLUTION 2To urge and request the Louisiana State Police to work in conjunction with the Louisiana 3 office of motor vehicles, the Louisiana Department of Transportation and 4 Development, and the Louisiana Motor Transport Association to study the feasibility 5 of updating the process and applicable fees for the inspection of commercial motor 6 vehicles required to be inspected under the provisions of federal regulations. 7 WHEREAS, R.S. 32:1306(C)(5) provides for the operation of official inspection 8stations and provides in pertinent part for the fees charged for the inspection of all 9commercial motor vehicles required to be inspected under the provisions of Part 396 of Title 1049 of the Code of Federal Regulations, including Part 396.17 and "Appendix G" thereof; and 11 WHEREAS, R.S. 32:1306(C)(5) also provides, in pertinent part, that the Legislature 12of Louisiana declares that a commercial motor vehicle inspection is much more extensive 13than state inspections and that the increase in the fee or charge for the inspection of 14commercial vehicles is based on the difference in the two types of inspections; and 15 WHEREAS, although the Legislature of Louisiana has recognized that the extensive 16inspection involved in a federal inspection of a commercial motor vehicle mandates an 17increase in fees compared to the state inspection of a commercial motor vehicle, there is no 18standard fee established for the inspection, causing fewer stations to offer federal 19inspections; and Page 1 of 3 HLS 22RS-5452 ORIGINAL HR NO. 268 1 WHEREAS, R.S. 32:1311(E)(2) authorizes the owner or operator of a commercial 2motor vehicle, truck, or tractor to obtain a Louisiana commercial motor vehicle inspection 3certificate to satisfy the requirements of federal regulations as an alternate means of 4compliance, yet with fewer stations offering the federal inspection, there are ongoing issues 5with the option to purchase either inspection and a select group of commercial motor 6vehicles that receive citations for failure to have the federal inspection. 7 THEREFORE, BE IT RESOLVED that the House of Representatives of the 8Legislature of Louisiana does hereby urge and request the Louisiana State Police to work in 9conjunction with the Louisiana office of motor vehicles, the Louisiana Department of 10Transportation and Development, and the Louisiana Motor Transport Association to study 11the feasibility of updating the process and applicable fees for the inspection of all 12commercial motor vehicles required to be inspected under the provisions of Part 396 of Title 1349 of the Code of Federal Regulations, including Part 396.17. 14 BE IT FURTHER RESOLVED that the Louisiana State Police, in conjunction with 15the Louisiana office of motor vehicles, the Louisiana Department of Transportation and 16Development, and the Louisiana Motor Transport Association, shall submit a report detailing 17the results of its study to the House of Representatives of the Legislature of Louisiana no 18later than February 1, 2023. 19 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the 20secretary of the Louisiana State Police, the Louisiana office of motor vehicles, the Louisiana 21Department of Transportation and Development, and the Louisiana Motor Transport 22Association.
