(gov sig) 1 AN ACT 2 To enact Civil Code Art. 3493.11, relative to liberative prescription; to provide for delictual 3 actions resulting from motor vehicle accidents; to provide for two-year prescription; 4 and to provide for related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. Civil Code Art. 3493.11 is hereby enacted to read as follows: 7 Art. 3493.11. Delictual actions; two-year prescription; motor vehicle accidents 8 Delictual actions which arise due to damages sustained as a result of a 9 motor vehicle accident are subject to a liberative prescription of two years. This 10 prescription commences to run from the day injury or damage is sustained. 11 Section 2. The provisions of this act shall have prospective application only and shall 12 apply only to a cause of action arising on or after the effective date of this Act. 13 Section 3. This Act shall become effective upon signature by the governor or, if not 14 signed by the governor, upon expiration of the time for bills to become law without signature 15 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 16 vetoed by the governor and subsequently approved by the legislature, this Act shall become 17 effective on the day following such approval.
